Ken and I have been working together

أنا و" كين " نعمل سوية منذ ..

for almost 40 years.

مايقارب 40 عاماً

That's Ken Sharpe over there.

ها هو كين شارب هناك ..

So there is among many people --

يستشري اليوم بين الناس

certainly me and most of the people I talk to --

وخاصة انا ومعظم الاشخاص الذين أتحدث إليهم

a kind of collective dissatisfaction

نوع من تراكم عدم الرضى

with the way things are working,

بسبب الطريقة التي تسير بها الامور هذه الايام

with the way our institutions run.

والطريقة التي تُسير بها المؤسسات

Our kids' teachers seem to be failing them.

فالمعلمين يخذلون آمالنا بهم فيما يتعلق بتعليم أطفالنا

Our doctors don't know who the hell we are,

ودكاترتنا لا تعلم من نحن ولا من أي فصيلة قدمنا

and they don't have enough time for us.

ولا يملكون الوقت الكافي لنا

We certainly can't trust the bankers,

ونحن حتماً اليوم لا يمكننا الوثوق بالبنوك

and we certainly can't trust the brokers.

ولا يمكننا الوثوق بالمضاربين - سماسرة الاسهم -

They almost brought the entire financial system down.

الذين كان السبب الاساسي في الانهيار الاقتصادي

And even as we do our own work,

وحتى أثناء قيامنا بعملنا الخاص

all too often,

فنحن عادة نقع بين خيارين

we find ourselves having to choose

اما ان نختار ان نقوم

between doing what we think is the right thing

بالامر الصحيح ..

and doing the expected thing,

او ان نقوم بما هو متوقع منا ان نقوم به

or the required thing,

او الامر المطلوب منا

or the profitable thing.

او الامر ذا المردود المادي الاكبر

So everywhere we look,

اذا في كل مكان ننظر اليه

pretty much across the board,

سواء الاماكن القريبة او البعيدة

we worry that the people we depend on

فاننا نرى ان الاشخاص الذين نعتمد عليهم

don't really have our interests at heart.

لا يأخذون مصالحنا بعين الاعتبار والاهتمام

Or if they do have our interests at heart,

وإن كانوا كذلك

we worry that they don't know us well enough

فنحن نخاف من انهم لا يعوون تماما

to figure out what they need to do

كيف يدركون كيفية القيام بالاشياء

in order to allow us

لكي يضمنوا لنا

to secure those interests.

الايفاء بمصالحنا

They don't understand us.

فهم لا يفهموننا على الاطلاق

They don't have the time to get to know us.

فلا وقت لديهم لكي يتعرفوا علينا

There are two kinds of responses

هناك طريقتين للتجاوب

that we make

نقوم بها

to this sort of general dissatisfaction.

تجاه هذا الوضع من عدم الرضى العام المصابين به

If things aren't going right,

اذا لم تسر الامور على نحو جيد

the first response is:

فان التصرف الاول هو ..

let's make more rules,

هلموا نصنع قوانين جيدة ..

let's set up a set

حزمة اوامر جديدة ..

of detailed procedures

من الاجراءات المفصلة ..

to make sure that people will do the right thing.

لكي نفهم الناس كيفية القيام بالامر الصحيح

Give teachers scripts

لنعطي المعلمين " كتالوجات "

to follow in the classroom,

لكي يتبعوها في الفصول الدراسية

so even if they don't know what they're doing

لذا حتى ان لم يكونوا قد استوعبوا مالذي يقومون به

and don't care about the welfare of our kids,

او كانوا لا يهتمون بالمردود العلمي للطلاب فهذا لا يهم

as long as they follow the scripts,

لانهم يتبعون تلك الكاتولوجات - الكودات - الادلة

our kids will get educated.

وحتما سوف يحصل الاطفال -بوجهة نظرهم - على التعليم الكافي ..

Give judges a list of mandatory sentences

او في مجال الاخر .. لنعطي القضاة قائمة احكام الزامية

to impose for crimes,

لكي تطبق على الجرائم

so that you don't need to rely

لذا لا يضطر العامة من الاعتماد

on judges using their judgment.

على رأي القاضي الخاص فيما يخص الاحكام

Instead, all they have to do

وبدلا من هذا كل الذي يتوجب عليهم القيام به

is look up on the list

او النظر في تلك القائمة

what kind of sentence goes with what kind of crime.

ومطابقة الحكم معه الجريمة .. واعلانه فحسب

Impose limits

أو لنفرض قيود

on what credit card companies can charge in interest

عن قيمة الفائدة المسموحة

and on what they can charge in fees.

او قيمة الرسوم المفروضة

More and more rules

لنفرض قواعد وقوانين اكثر واكثر

to protect us

لكي نحمي انفسنا

against an indifferent, uncaring

ضد المؤسسات اللامبالية

set of institutions we have to deal with.

والغير مهتمة التي يتوجب علينا التعامل معها

Or -- or maybe and --

او ربما .. وأقول ربما ..

in addition to rules,

بالاضافة الى القوانين

let's see if we can come up

لنرى ان كان من الممكن

with some really clever incentives

وضع بعض الحوافز الذكية

so that, even if the people we deal with

لانه عندما نتعامل مع اشخاص

don't particularly want to serve our interests,

لايهتمون فعلاً بمصالحنا ..

it is in their interest

فان تلك الحوافز ستجعلهم كذلك من اجل مصلحتهم

to serve our interest --

خدمتنا .. والاهتمام بما ..

the magic incentives

ان تلك الحوافز السحرية

that will get people to do the right thing

سوف تجعل الناس يقومون بالتصرف الصحيح ..

even out of pure selfishness.

الناتج عن الأنانية المطلقة

So we offer teachers bonuses

لذا فنحن نوفر العلاوات للمدرسين

if the kids they teach

اذا حصل طلابهم الذين يدرسونهم

score passing grades on these big test scores

على علامات مرتفعة في امتحانات الفصول الانتقالية

that are used to evaluate

فالحوافز تلك تستخدم

the quality of school systems.

لرفع كفاءة انظمة التعليم

Rules and incentives --

بواسطة القوانين والحوافز

"sticks" and "carrots."

كما العصى والجزرة

We passed a bunch of rules

لقد قمنا بسن قوانين جديدة

to regulate the financial industry

لكي ننظم العملية الاقتصادية

in response to the recent collapse.

كرد فعل على الانهيار المالي الماضي

There's the Dodd-Frank Act,

فقد سن قانون ( دود-فرانك ) من قبل أوباما

there's the new Consumer Financial Protection Agency

وهي مؤسسة حماية اقتصادية للزبائن ..

that is temporarily being headed through the backdoor

والتي تحاول الوصول الى مقاربات حلول عن طريق طرق جديدة

by Elizabeth Warren.

بواسطة إليزبت وارن ..

Maybe these rules

ربما هذه القوانين الجديدة

will actually improve

سوف تُحسن

the way these financial services companies behave.

الطريقة التي تتعامل بها الشركات المالية

We'll see.

سوف نرى

In addition, we are struggling

في المقابل نحن نعاني

to find some way to create incentives

في سبل ايجاد طريقة جديدة لابتداع حوافز

for people in the financial services industry

للاشخاص الذين يعملون في النظام المالي

that will have them more interested

لكي نجعلهم اكثر اهتماماً

in serving the long-term interests

في خدمة المصالح بعيدة الامد

even of their own companies,

حتى فيما يخص شركاتهم

rather than securing short-term profits.

بدلاً من محاولة قنص الارباح قصيرة الامد

So if we find just the right incentives,

لذا ان وجدنا الحوافز الملائمة

they'll do the right thing -- as I said -- selfishly,

سوف يقومون بالامر الصحيح .. وكما اقول ..تبعاً لأنانيتهم

and if we come up with the right rules and regulations,

واذا قمنا بعمل قوانين و نظم جديدة وصحيحة

they won't drive us all over a cliff.

لن يستطيعوا السير بنا الى الهاوية مرة اخرى

And Ken [Sharpe] and I certainly know

وكين شارب .. وانا نعلم

that you need to reign in the bankers.

ان اكثر ما نحتاج اليه .. هو كبح جماح المصرفيين

If there is a lesson to be learned from the financial collapse

اذا كان هنالك درس يمكن تعلمه من الانهيار الاقتصادي

it is that.

هو هذا

But what we believe,

ولكننا نؤمن - انا وشريكي -

and what we argue in the book,

وهذا الذي كتبناه في كتبانا

is that there is no set of rules,

انه لا يوجد عدد كاف من القواعد او القوانين

no matter how detailed,

مهما كانت مفصلة

no matter how specific,

ومهما كانت واضحة

no matter how carefully monitored

ومهما تم مراقبتها بوضوح وبحزم

and enforced,

وكيفما تم فرضها

there is no set of rules

مهما كان عددها

that will get us what we need.

Why? Because bankers are smart people.

And, like water,

they will find cracks

in any set of rules.

You design a set of rules that will make sure

that the particular reason

why the financial system "almost-collapse"

للانهيار المالي

can't happen again.

من ان تحدث مجدداً

It is naive beyond description

انه امرٌ ساذج جداً

to think that having blocked

لكي نتخيل انه يمكننا ان نوقف

this source of financial collapse,

مسببات الانهيار المالي

you have blocked all possible sources of financial collapse.

او ايقاف كل الممسببات التي يمكن ان تؤدي الى الانهيار المالي

So it's just a question of waiting for the next one

اننا في وضع انتظار الانهيار التالي فيحسب

and then marveling at how we could have been so stupid

وللأسف يشير كل هذا الى مدى حمقنا ..

as not to protect ourselves against that.

في بقائنا غير محمين تجاه هذا الخطر مرة تلو الاخرى

What we desperately need,

ان ما نحتاجه بالفعل

beyond, or along with, better rules

بالتوازي .. هو قوانين أفضل

and reasonably smart incentives,

وحوافز ذكية منطقية اكثر

is we need virtue.

نحن نحتاج الاستقامة

We need character.

نحتاج الشخصية الملائمة

We need people who want to do the right thing.

نحتاج الاشخاص الذين يرغبون فعلاً بالقيام بالامر الصحيح

And in particular,

وفي الحقيقة

the virtue that we need most of all

الاستقامة هي محور ما نحتاجه

is the virtue that Aristotle called

نحتاج الاستقامة التي وصفها أرسطو

"practical wisdom."

بالحكمة العملية

Practical wisdom

الحكمة العملية

is the moral will

هي رغبة اخلاقية

to do the right thing

في القيام بالامر الصحيح

and the moral skill

والمهارة الاخلاقية

to figure out what the right thing is.

هي اكتشاف الطريق الصحيح لذلك

So Aristotle was very interested in watching

لذا كان أرسطوا مهتماً جداً بمشاهدة

how the craftsmen around him worked.

كيف يقوم الحرفيون بأعمالهم

And he was impressed

وكان متأثرأً جداً

at how they would improvise

بكيفية تطبيقهم الحلول المرتجلة

novel solutions to novel problems --

على تلك المشاكل التي تجابههم

problems that they hadn't anticipated.

تلك المشاكل الغير متوقعة

So one example is he sees these stonemasons

على سبيل المثال .. عندما يرى الحجار

working on the Isle of Lesbos,

يعمل على جزيرة ليسبوس

and they need to measure out

ويحتاج ان يقوم بعملية قياس

round columns.

أعمدة دائرية

Well if you think about it,

فكروا بالموضوع ..

it's really hard to measure out round columns using a ruler.

انه لمن الصعب قياس الاعمدة الدائرية باستخدام المسطرة المستقيمة ..

So what do they do?

اذا ماذا يمكن القيام حيال هذا ..

They fashion a novel solution to the problem.

هناك حل ابداعي لهذه المشكلة

They created a ruler that bends,

وهو اختراع مسطرة تنحني ..

what we would call these days a tape measure --

وهو شريط القياس الذي نستخدمه اليوم

a flexible rule,

إنها مسطرة مرنه ..

a rule that bends.

يمكن ان تنحني

And Aristotle said,

وقال ارسطو حيال هذا ..

"Hah, they appreciated that sometimes

أها .. لقد فهموا - الحرفيين -

to design rounded columns,

انه لتصميم الاعمدة الدائرية

you need to bend the rule."

يتجوب علينا ان نحني " المقياس "

And Aristotle said

وقال ارسطوا ..

often in dealing with other people,

انه ايضاً عند التعامل مع الاخرين

we need to bend the rules.

احيانا نحتاج ان نحني بعض القوانين

Dealing with other people

فالتعامل مع الاخرين

demands a kind of flexibility

يتطلب نوعاً من المرونة

that no set of rules can encompass.

لا يمكن لاي حزمة من المقايس ضبطها او ان تشملها

Wise people know when and how

ان الحكماء يعرفون

to bend the rules.

متى وكيف يمكن حني القوانين

Wise people know how to improvise.

ان الحكماء يعرفون كيفية الارتجال في هكذا مواقف

The way my co-author , Ken, and I talk about it,

ان الطريقة التي نصفها - انا شريكي المؤلف -

they are kind of like jazz musicians.

هي ان الامر يشبه عازفي موسيقى الجاز

The rules are like the notes on the page,

فان القوانين .. هي مثل النوتة الموسيقية

and that gets you started,

وهي التي تجعلك تبدأ العزف ..

but then you dance around the notes on the page,

ولكن لاحقاً كل عازف يخرج عن النص بما تقتضيه الحالة

coming up with just the right combination

لكي يعزف التركيبة الملائمة للوضح المحيط به

for this particular moment

والظروف العملية

with this particular set of fellow players.

و العازفين المشاركين معه أيضاً

So for Aristotle,

لذا بالنسبة لأرسطو

the kind

ان القيام

of rule-bending,

بحني القواعد - القوانين -

rule exception-finding and improvisation

او تخطي القوانين .. او الاستثناءات

that you see in skilled craftsmen

التي تراها في الحرفي الماهر ..

is exactly what you need

هي ما نحتاجه تماماً

to be a skilled moral craftsman.

في الحرفي الاخلاقي

And in interactions with people,

وفي التواصل مع الناس والاشخاص

almost all the time,

معظم الوقت

it is this kind of flexibility that is required.

فان المرونة هي المتطلب الاساسي لذلك

A wise person knows when to bend the rules.

الحكيم يعي تماما الوقت الذي يجب حني القواعد فيه

A wise person knows when to improvise.

والحكيم يعرف تماما كيف ومتى يرتجل

And most important,

والاهم من هذا كله

a wise person does this improvising and rule-bending

ان الحكيم يقوم بتخطي ( حني ) القوانين والارتجال

in the service of the right aims.

خدمة المصلحة العامة .. او الاهداف الصحيحة ..

If you are a rule-bender and an improviser

ان كنت من هؤلاء الذين يحنون القواعد .. او يرتجلون ..

mostly to serve yourself,

فانت على الاغلب تخدم نفسك

what you get is ruthless manipulation of other people.

فأنت تتلاعب بالامور وبالاخرين من اجل مصلتحك الشخصية

So it matters that you do this wise practice

ومن الضروري القيام بذلك بصورة حكيمة

in the service of others

من اجل خدمة الاخرين

and not in the service of yourself.

لا خدمة نفسك

And so the will to do the right thing

لذا ان الرغبة بالقيام بالامر الصحيح

is just as important as the moral skill

هي هامة جداً .. بنفس المهارة الخلقية

of improvisation

للارتجال

and exception-finding.

ولايجاد الاستثناءات

Together they comprise practical wisdom,

فمعاً يشكلان الحكمة العملية

which Aristotle thought

والتي كان

was the master virtue.

أرسطو خبيراً بها .. وعلامة باستقامته

So I'll give you an example

حسناً .. سوف اعطيكم مثالاً

of wise practice in action.

عن الحكمة العملية في الواقع

It's the case of Michael.

انها قضية ميشيل ..

Michael's a young guy.

ميشيل هو شاب يافع

He had a pretty low-wage job.

لديه وظيفة براتب قليل جداً

He was supporting his wife and a child,

وكان يعيل زوجته وابنه ..

and the child was going to parochial school.

وكان الابن يذهب الى مدرسة أبرشية

Then he lost his job.

ومن ثم فقد عمله ..

He panicked

وذعر

about being able to support his family.

حيال إعالة عائلته

One night, he drank a little too much,

وفي ليلة من الليالي .. شرب كثيراًُ حتى سكر .

and he robbed a cab driver --

وسرق سائق اجرة

stole 50 dollars.

لقد سرق منه 50 دولار

He robbed him at gunpoint.

لقد سرقه مهدداً اياه بسلاح ..

It was a toy gun.

كان سلاح مزيف ( لعبة )

He got caught. He got tried.

تم القاء القبض عليه .. ومن ثم محاكمته

He got convicted.

ومن ثم ادانته

The Pennsylvania sentencing guidelines

ان نظم احكام بنسيلفينا

required a minimum sentence for a crime like this

تنص على ان الحكم الادني لهكذا جريمة

of two years, 24 months.

سنتين .. أي 24 شهراً

The judge on the case, Judge Lois Forer

وكانت القاضية في هذه القضية هو " لويس فورير "

thought that this made no sense.

وقد رأى ان هذا لا منطقي على الاطلاق

He had never committed a crime before.

على اعتبار انه لم يرتكب اي جريمة فيما مضى

He was a responsible husband and father.

وهو زوج ووالد مسؤول

He had been faced with desperate circumstances.

وقد تعرض لظروف محبطة

All this would do is wreck a family.

وان هذا الحكم قد يدمر عائلته

And so she improvised a sentence -- 11 months,

لذا فقد غيرت الحكم الى 11 شهراً

and not only that,

وليس هذا فحسب ..

but release every day to go to work.

بس سمحت له بالذهاب الى العمل يومياً

Spend your night in jail, spend your day holding down a job.

اي ان يقضي الليل في السجن .. والصباح في العمل

He did. He served out his sentence.

وقد قام بهذا .. وادى عقوبته

He made restitution

ولقد عوض ما فات ..

and found himself a new job.

ووجد وظيفة جديدة ..

And the family was united.

ولم تفكك اسرته

And it seemed on the road

وهو على ما يبدو على الطريق

to some sort of a decent life --

الصحيح في انشاء حياة لائقة لاسرته

a happy ending to a story

وهذه نهاية سعيدة

involving wise improvisation

تشكلت بسبب الارتجال الحكيم

from a wise judge.

من القاضية الحكيمة

But it turned out

ولكن تبين

the prosecutor was not happy

ان المدعي العام لم يكن سعيداً بهذا

that Judge Forer ignored the sentencing guidelines

ولم يرضى بتجاهل القوانين الموضوعة من قبل القاضية فورير

and sort of invented her own,

ولا بتلك التي قامت بارتجالها

and so he appealed.

لذا قدم استئناف

And he asked for the mandatory minimum sentence

وطالب بالحد الادنى من العقوبة الالزامية

for armed robbery.

للسرقة المسلحة

He did after all have a toy gun.

فهو كان يملك مسدساً .. وان كان مزيفاً

The mandatory minimum sentence for armed robbery

والحد لادنى من العقوبة الالزامية للسرقة المسلحة

is five years.

هو 5 سنوات

He won the appeal.

وقد ربح الاستئناف

Michael was sentenced to five years in prison.

وتم ارسال ميشيل ليقضي 5 سنوات في السجن

Judge Forer had to follow the law.

وكان يتوجب على القاضية فورير اتباع القانون هذه المرة

And by the way, this appeal went through

وبالمناسبة قد وضع الاستئناف

after he had finished serving his sentence,

بعد ان كان ميشيل قد اتم حكمه السابق

so he was out and working at a job

وكان قد بدأ في العمل في وظيفته الجديدة

and taking care of his family

والاعتناء بعائلته

and he had to go back into jail.

وقد أعيد الى السجن

Judge Forer did what she was required to do,

لقد قامت القاضية فورير بما يتوجب عليها القيام به ..

and then she quit the bench.

ومن ثم قدمت استقالتها

And Michael disappeared.

واختفى ميشيل

So that is an example,

لذا هذا مثال

both of wisdom in practice

عن الحكمة في الواقع العملي

and the subversion of wisdom

وعن الافتقار للحكمة في الواقع العملي ايضاً

by rules that are meant, of course, to make things better.

بواسطة القوانين والقواعد التي هي في الاساس وضعت لكي نقوم بالامور على النحو الصحيح

Now consider Ms. Dewey.

الان لنأخذ قضية السيدة ديوي

Ms. Dewey's a teacher in a Texas elementary school.

السيدة ديوي هي مُدرسة في مَدرسة ابتدائية في ولاية تكساس

She found herself listening to a consultant one day

وجدت نفسها ذات يوم تستمع لاستشارة

who was trying to help teachers

كانت تستهدف لمساعدة المدرسين

boost the test scores of the kids,

لرفع نتائج علامات الطلاب

so that the school

لكي يتسنى للمدرسة ان تصنف

would reach the elite category

ضمن مدارس النخبة

in percentage of kids passing big tests.

بعد ان تحقق النسبة المطلوبة من نجاح الطلاب لديها

All these schools in Texas compete with one another

وكل المدارس في ولاية تكساس تتسابق فيما بينها

to achieve these milestones,

كل تحقق هذه الارقام

and there are bonuses and various other treats

وهناك حوافز وجوائز .. ومميزات

that come if you beat the other schools.

تحصل عليها المدرسة ان استطاعت ان تهزم باقي المكاتب

So here was the consultant's advice:

وكانت نصيحة المستشار حينها

first, don't waste your time on kids

الاولى .. لا تهدروا الوقت على الطلاب الذين

who are going to pass the test no matter what you do.

سوف ينجحون دون مساعدتكم

Second, don't waste your time

الثانية .. لاتهدروا الوقت على الطلاب الذين

on kids who can't pass the test

مهما فعلتم ..

no matter what you do.

لن ينجحوا

Third, don't waste your time

الثالثة .. لا تهدروا وقتكم

on kids who moved into the district

على الطلاب الذين انتقلوا من ولايات اخرى

too late for their scores to be counted.

بوقت متأخر بحيث نتائجهم لن تؤخذ بعين الاعتبار

Focus all of your time and attention

ركزوا كل وقتكم واهتماكم

on the kids who are on the bubble,

على الاطفال الذين يقعون على الخط ..

the so-called "bubble kids" --

انهم يدعون " اطفال الفقاعة "

kids where your intervention

اطفال بحيث يمكن بتدخل المدرسين

can get them just maybe over the line

وببذل مجهودهم عليهم

from failing to passing.

ان ينتقلوا من حافة الرسوب الى حافة النجاح

So Ms. Dewey heard this,

لقد سمعت السيدة ديوي هذا

and she shook her head in despair

وهزت رأسها محبطة

while fellow teachers were sort of cheering each other on

بينما كان باقي المدرسين يشجعون بعضهم البعض

and nodding approvingly.

ويهزون رؤوسهم موافقة لما يقال

It's like they were about to go play a football game.

لقد كان الامر كما لعب كرة القدم

For Ms. Dewey,

بالنسبة للسيدة ديوي

this isn't why she became a teacher.

انه ليس الامر الذي جعلها في البداية دخول مجال التدريس

Now Ken and I are not naive,

حسناً .. كين و انا لسنا سُذج

and we understand that you need to have rules.

ونحن نفهم انكم تريدون الحصول على قوانين جديدة

You need to have incentives.

وانتم تحتاجون الحوافز

People have to make a living.

والناس تحتاج ان تعيل نفسها

But the problem

ولكن المشكلة ..

with relying on rules and incentives

بالاعتماد على القوانين والحوافز

is that they demoralize

فان هذا

professional activity,

يحبط التصرفات المحترفة

and they demoralize professional activity

وهي تحبط التصرفات المحترفة

in two senses.

بصورتين ..

First, they demoralize the people

فالاولى انها تحبط الاشخاص

who are engaged in the activity.

المنخرطين بالمهام

Judge Forer quits,

مما يؤدي إلى استقالة " القاضية فورير "

and Ms. Dewey in completely disheartened.

والى إبتأس السيدة ديوي

And second,

والثانية

they demoralize the activity itself.

انها تحبط المهمة نفسها

The very practice is demoralized,

لانها تحبط العمل ذاته

and the practitioners are demoralized.

والعاملين عليه ..

That is to say, it creates people

وهذا يعني .. ان الناس لن تقوم بالعمل الصحيح

who only do things for incentives.

Now the striking thing about this

is that psychologists have known this

about the negative consequences of incentivizing everything

We know that if you reward kids for drawing pictures,

they stop caring about the drawing

and only care about test preparation.

If you were to reward doctors

واذا كافئت الاطباء

for doing more procedures --

لقيامهم بعدد اكبر من العمليات الجراحية

which is the current system -- they would do more.

وهذا الامر يحدث اليوم .. سوف يرغبون بالقيام بعمليات اكثر

If instead you reward doctors for doing fewer procedures,

مما لو تم مكافئتهم عند حل المشاكل بعمليات اقل ..

they will do fewer.

لانهم حينها سوف يقومون بعدد اقل ..

What we want, of course,

ان ما نريده حقيقة .. بالطبع

is doctors who do just the right amount of procedures

هو ان يقوم الاطباء بالعدد الصحيح من العمليات الجراحية ..

and do the right amount for the right reason --

والقيام بالعدد الصحيح للاسباب الصحيحة

namely, to serve the welfare of their patients.

أي لخدمة المرضى الخدمة الامثل

Psychologists have known this for decades,

and it's time for policymakers

to start paying attention

and listen to psychologists a little bit,

instead of economists.

And it doesn't have to be this way.

We think, Ken and I, that there are real sources of hope.

We identify one set of people

in all of these practices

who we call canny outlaws.

These are people

who, being forced to operate

in a system that demands rule-following

and creates incentives,

find away around the rules,

find a way to subvert the rules.

So there are teachers who have these scripts to follow,

and they know that if they follow these scripts, the kids will learn nothing.

And so what they do is they follow the scripts,

but they follow the scripts at double-time

ولكن يتبعونها بنظام اسرع

and squirrel away little bits of extra time

during which they teach in the way

that they actually know is effective.

So these are little ordinary, everyday heroes,

and they're incredibly admirable,

but there's no way that they can sustain this kind of activity

ولكنهم لن يستطيعوا الاستمرار بهكذا تصرفات

in the face of a system

that either roots them out

فاما انه سيتم اجتثاثهم ..

or grinds them down.

او سيتم منعهم عن القيام بذلك

So canny outlaws are better than nothing,

ان المتحايلون الماكرون .. افضل من لا شيء ..

but it's hard to imagine any canny outlaw

ولكن من الصعب توقع استمرار اي من هؤلاء المتحالين

sustaining that for an indefinite period of time.

ان يستمروا في هذا التصرف وقتاً طويلاً

More hopeful

ولكن ما يدعو للأمل اكثر

are people we call system-changers.

هم الاشخاص الذين ندعوهم " مغيروا النظم "

These are people who are looking

نهم اشخاص يتطلعون

not to dodge the system's rules and regulations,

للتحايل على القواعد والنظم

but to transform the system,

بل على تغيرها

and we talk about several.

.وقد ذكرنا بعضهم ..

One in particular

وعلى سبيل المثال سوف اذكر

is a judge named Robert Russell.

القاضي روبرت راسل ..

And one day he was faced

في احد الايام واجه

with the case of Gary Pettengill.

قضية " جاري بيتينجيل "

Pettengill was a 23-year-old vet

وكان بيتينجيل .جندي عريق عمره 23 عاماً

who had planned to make the army a career,

كان يخطط ان يستقر في الجيش مدى الحياة

but then he got a severe back injury in Iraq,

ولكنه اصيب بجراح بالغة في حرب العراق

and that forced him to take a medical discharge.

وقد تم تسريحه تسريح طبي تبعاً لذلك

He was married, he had a third kid on the way,

وكان متزوجاً .. وكانت زوجته حاملاً بالطفل الثالث

he suffered from PTSD, in addition to the bad back,

وقد عانى من اضطراب ما بعد الصدمة بالاضافة الى ظهره المعطوب

and recurrent nightmares,

والكوابيس المزعجة

and he had started using marijuana

وقد بدأ باستخدم الماريجونا

to ease some of the symptoms.

لكي يسيطر على بعض العوارض التي كانت تعتريه

He was only able to get part-time work because of his back,

ولم يستطع الحصول الا على عمل بدوام جزئي بسبب اعاقته

and so he was unable to earn enough to put food on the table

ولم يكن قادراً على توفير الطعام الكافي لعائلته

and take care of his family.

ولا الاهتمام بها

So he started selling marijuana.

لذا بدأ بالاتجار بالماريجونا

He was busted in a drug sweep.

وتم القاء القبض عليه اثناء عملية بيع

His family was kicked out of their apartment,

وتم طرد عائلته من شقتهم

and the welfare system

وكان نظام الرعاية الاجتماعية

was threatening to take away his kids.

يهدد بأخذ اطفاله

Under normal sentencing procedures,

وتبعاً للقوانين المكتوبة والمنصوص عليها

Judge Russell would have had little choice

لم يكن امام القاضي راسل الكثير من الخيارات

but to sentence Pettengill to serious jail-time

الا لارسال بيتنيجيل الى السجن

as a drug felon.

كمتهم بقضية مخدرات

But Judge Russell did have an alternative.

ولكن القاضي رسل قام ببديل

And that's because he was in a special court.

وذلك لانه كان في محكمة خاصة

He was in a court called the Veterans' Court.

كان في محكمة المحاربين القدامي

In the Veterans' Court --

وفي محكمة المحاربين القدامى

this was the first of its kind in the United States.

كانت هذه سابقة من نوعها في تاريخ الولايات المتحدة الامريكية

Judge Russell created the Veterans' Court.

ان القاضي رسل .. هو الذي اسس هذه المحكمة

It was a court only for veterans

وكانت هذه المحكمة معنية فحسب

who had broken the law.

بقدامى المحاربين الذين خالفوا القانون

And he had created it exactly because

وقد اسسها خصوصاً

mandatory sentencing laws

لكي تخرج الاحكام عنها

were taking the judgment out of judging.

تبعا لحكم القاضي ولظروف القضية بمنأى عن القوانين والقواعد

No one wanted non-violent offenders --

لانه لا احد يريد ان يرمى .. احد المعتدين الغير " عدائين "

and especially non-violent offenders who were veterans to boot --

وخاصة ان كان ممن خدم الوطن في زي الجيش

to be thrown into prison.

في السجن

They wanted to do something about what we all know,

كانوا يريدون ان يقوموا بشيء يمكننا وصفه جميعاً

namely the revolving door of the criminal justice system.

وهو فتح منفذ قانوني في النظام العدلي

And what the Veterans' Court did,

وهذا ما فعلته محكمة قدامى المحاربين

was it treated each criminal as an individual,

والتي تحاكم كل متهم وكأنه قضية معزولة تماما عن النسق العام

tried to get inside their problems,

وتحاول ان تتفهم مشاكلهم

tried to fashion responses to their crimes

وتحاول ان تؤقلم الاحكام الصادرة تبعاً لتلك المشاكل

that helped them to rehabilitate themselves,

والتي تساعد في اعادة بناء شخصية المحارب القديم

and didn't forget about them once the judgment was made.

كما انها لا تنسى المحكوم بعد ان يصدر الحكم

Stayed with them, followed up on them,

بل تبقى معه .. وتتابع حالته

made sure that they were sticking to whatever plan

وتتأكد من انه ملتزم بخطة اعادة التأهيل التي فرضت عليه

had been jointly developed

وانه تم اعادة دمجه في المجتمع بصورة صحيحة

to get them over the hump.

لكي يتغلبوا على ذلك العائق الذي اعتراهم

There are now 22 cities

واليوم هناك في 22 مدينة

that have Veterans' Courts like this.

محاكم قدامى المحابين ..

Why has the idea spread?

لماذا انتشرت هذه الفكرة ..

Well, one reason is

حسناً السبب هو

that Judge Russell

ان القاضي راسل

has now seen 108 vets

قد نظر في قضية 108 محارب قديم

in his Veterans' Court

في محكمته الخاصة بهم

as of February of this year,

وحتى شهر فبراير من هذا العام

and out of 108,

فانه من 108 حالة

guess how many have gone back through

كم تتوقعون انه ادخل

the revolving door of justice

into prison.

Anyone would glom onto

a criminal justice system

that has this kind of a record.

So here's is a system-changer, and it seems to be catching.

وهذا هو احد مغيري النظم والقوانين

There's a banker

وهنالك مصرفي

who created a for-profit community bank

اسس مصرف يعنى بالارباح الاجتماعية

that encouraged bankers -- I know this is hard to believe --

شجع المصرفيين - اعرف ان هذا يصعب تصديقه -

encouraged bankers who worked there to do well

شجع المصرفيين الذين يعملون معه

by doing good for their low-income clients.

على القيام بالامور الصحيحة من اجل عملائهم ذوي الدخل المحدود

The bank helped finance the rebuilding

لقد ساعد ذلك البنك المجتمع المحيط به

of what was otherwise a dying community.

باعادة بناء نفسه بعد ان كان ينهار

Though their loan recipients were high-risk by ordinary standards,

على اعتبار ان الاشخاص الذين يتم اقراضهم .. هم اشخاص مصنفون بدرجة خطر عالية بحسب المواصفات الاعتيادية

the default rate was extremely low.

وكانت نسب العوائد قليلة جداً

The bank was profitable.

ولكن البنك ربح

The bankers stayed with their loan recipients.

وبقي المصرفيون مع الدائنين

They didn't make loans and then sell the loans.

فهم لم يعطوا القروض ومن ثم يبيعونها

They serviced the loans.

بل خدموا تلك القروض

They made sure that their loan recipients

وتأكدوا من ان دائنيهم

were staying up with their payments.

سوف يستمرون بالدفع بالصورة الملائمة لهم

Banking hasn't always been

ان النظام المصرفي لم يكن

the way we read about it now in the newspapers.

هكذا .. بالصورة التي نقرأ عنها في الصحف اليوم

Even Goldman Sachs

حتى " جولدمان ساشس "

once used to serve clients,

كانت تخدم عملائها

before it turned into an institution

قبل ان تتحول الى مؤسسة

that serves only itself.

تخدم نفسها فحسب

Banking wasn't always this way,

ان النظام المصرفي لم يكن كما هو الان ..

and it doesn't have to be this way.

ولا يتوجب عليه ان يبقى هكذا ..

So there are examples like this in medicine --

وهناك امثلة عن هؤلاء الاشخاص ايضاً

doctors at Harvard

في كلية الطب في هارفرد

who are trying to transform medical education,

الذين يحاولون ان يغيروا انظمة التعليم الطبية

so that you don't get a kind of ethical erosion

لكي لا يخرج اطباء يعانون من نقص في الاخلاقيات

and loss of empathy,

او نقص في التعاطف

which characterizes most medical students

والذي يوصف به معظم طلاب الطب

in the course of their medical training.

اثناء تدريبهم في الكليات الطبية

And the way they do it is to give third-year medical students

والطريقة التي يقومون بها .. هي باعطاء طلاب السنة الثالثة

patients who they follow for an entire year.

مرضى يتابعونهم طيلة العام

So the patients are not organ systems,

لذا هنا المرضى .. ليسوا اعضاء حيوية ..

and they're not diseases;

وليسوا امراض عرضية

they're people, people with lives.

هم اشخاص . .يعيشون تماما مثل اي شخص ..

And in order to be an effective doctor,

ولكي تصبح طبيباً فعالاً

you need to treat people who have lives and not just disease.

عليك ان تعامل الناس الذين يطلبون استشارتك كما لو انهم بشر .. لا كما لو انهم مجرد امراض تحتاج الى حل

In addition to which there's an enormous amount of back and forth,

كما انه هناك الكثير من اختبارات المراقبة التي تتم

mentoring of one student by another,

بين الطلاب انفسهم ..

of all the students by the doctors,

وبين الطلاب وبين مدرسيهم حيال هذا الامر ..

and the result is a generation -- we hope -- of doctors

والنتيجة .. هي كما نأمل جيل من الاطباء

who do have time for the people they treat.

لديهم الوقت الكافي لمرضاهم

We'll see.

So there are lots of examples like this that we talk about.

Each of them shows that it is possible

to build on and nurture character

and keep a profession

والابقاء على الاحترافية في العمل

true to its proper mission --

what Aristotle would have called its proper telos.

والذي قد يصفها أرسطو بالشخصية الملائمة

And Ken and I believe

وانا و شريكي كيم نؤمن

that this is what practitioners actually want.

ان هذا ما يريده حقاً الممارسون - ممارسون المهام -

People want to be allowed

الناس تحتاج ان تترك لكي

to be virtuous.

تصبح ارتجالية

They want to have permission to do the right thing.

ويريدون التصريح للقيام بالامر بالصورة الصحيحة

They don't want to feel

ولايريدون ان يشعروا ان عليهم

like they need to take a shower

ان يستحموا

to get the moral grime off their bodies everyday

لكي يتخلصوا من الضغط الاخلاقي الذي اعتراهم في يومهم الوظيفي

when they come home from work.

عندما يعودون الى المنزل

Aristotle thought that practical wisdom

لقد قال ارسطو ان الحكمة العملية

was the key to happiness,

الوسيلة الى السعادة

and he was right.

وهو مصيب في هذا

There's now a lot of research being done in psychology

هناك اليوم الكثير من الابحاث التي يتم القيام بها من قبل الاطباء النفسين

on what makes people happy,

عن ما الذي يجعل الناس سعداء

and the two things that jump out in study after study --

وهناك شيئان يظهران كانا في كل اختبار

I know this will come as a shock to all of you --

واعلم ان هذا سوف يصعقكم ..

the two things that matter most to happiness

ولكن اكثر امرين مهمين لسعادة المرء ..

are love and work.

هما الحب والعمل

Love: managing successfully

الحب : يعني القدرة على ادارة

relations with the people who are close to you

علاقاتنا بنجاح مع الاشخاص المحيطين بنا

and with the communities of which you are a part.

ومع المجتمعات التي ننتمي اليها

Work: engaging in activities

والعمل : يعني الانخراط بمهام

that are meaningful and satisfying.

مرضية وذات مغزى

If you have that, good close relations with other people,

وان كنت تملك هذا .. العلاقات القريبة القوية الجيدة

work that's meaningful and fulfilling,

والعمل الذي يشعرك بالانجاز والمعنى

you don't much need anything else.

فانت لا تحتاج اي شيء آخر

Well, to love well and to work well,

ولكي تحب بإخلاص .. وتعمل بإخلاص

you need wisdom.

فانت تحتاج الحكمة

Rules and incentives don't tell you

القوانين والحوافز لا تقول لك

how to be a good friend, how to be a good parent,

كيف يمكنك ان تكون صديقاً جيداً .. ولا كيف يمكنك ان تكون أباً جيداً

how to be a good spouse,

وكيف يمكنك أن تصبح زوجاً جيداً

or how to be a good doctor or a good lawyer

او كيف يمكن ان تصبح محامياً .. او طبيباً جيداً

or a good teacher.

او مدرساً جيداً

Rules and incentives

ان القوانين والحوافز

are no substitutes for wisdom.

ليست بديلاً للحكمة

Indeed, we argue,

ونحن نصر على انه

there is no substitute for wisdom.

لا بديل للحكمة ..

And so practical wisdom

والحكمة العملية

does not require

لاتتطلب منا

heroic acts of self-sacrifice

تصرفات بطولية وتضحية بالنفس

on the part of practitioners.

من جانب " ممارسين المهام "

In giving us the will and the skill

وهي - الحكمة العملية - بالاضافة لانها تعطينا الرغبة والمهارة

to do the right thing -- to do right by others --

للقيام بالامور الصحيحة للأخرين اثناء تأدية مهامنا وربما بواسطتهم

practical wisdom also gives us

فهي ايضاً تعطينا

the will and the skill

الارادة والمهارة

to do right by ourselves.
