Let me tell you a story

ကောင်မလေး Naghma ရဲ့ အကြောင်းကို

about a little girl named Naghma.

ကျွန်မ ပြောပြပါရစေ။

Naghma lived in a refugee camp

Naghma က ဒုက္ခသည်စခန်းမှာ

with her parents and her eight brothers and sisters.

Every morning, her father would wake up

in the hopes he'd be picked for construction work,

and on a good month he would earn 50 dollars.

ကောင်းတဲ့လမှာဆို ဒေါ်လာ ၅၀ လောက်ရပါတယ်။

The winter was very harsh,

ဆောင်းရာသီက ကြမ်းပြီးတော့

and unfortunately, Naghma's brother died

ကံမကောင်းစွာဘဲ Naghma အစ်ကိုက သေဆုံးသွားပြီး

and her mother became very ill.

သူမအမေက နာမကျန်းဖြစ်လာပါတယ်။

In desperation, her father went to a neighbor

မျှော်လင့်ချက်ကင်းမဲ့စွာနဲ့ သူမအဖေက

to borrow 2,500 dollars.

အိမ်နီးနားချင်းဆီကနေ ၂၅၀၀ ဒေါ်လာ ချေးခဲ့ပါတယ်။

After several months of waiting,

လအနည်းငယ် စောင့်ပြီးနောက်

the neighbor became very impatient,

အိမ်နီးနားချင်းက စိတ်မရှည်ဖြစ်လာပြီး

and he demanded that he be paid back.

ပြန်ဆပ်ဖို့ တောင်းဆိုလာပါတယ်။

Unfortunately, Naghma's father didn't have the money,

ကံမကောင်းတာက Naghma အဖေက ပိုက်ဆံမရှိပါဘူး။

and so the two men agreed to a jirga.

ဒါနဲ့ သူတို့က လူမျိုးရေးဆွေးနွေးပွဲ လုပ်ဖို့ သဘောတူလိုက်ပါတယ်။

So simply put, a jirga is a form of mediation

ရှင်းရှင်းပြောရရင် လူမျိုးရေးဆွေးနွေးပွဲဆိုတာ

အာဖဂန်ရဲ့ အစဉ်အလာမဟုတ်တဲ့ ဥပဒေစနစ်မှာ သုံးလေ့ရှိတဲ့ ဆွေးနွေးပွဲဖြစ်ပါတယ်။

that's used in Afghanistan's informal justice system.

It's usually presided over by religious leaders

များသောအားဖြင့် ဘာသာရေးခေါင်းဆောင် ရွာလူကြီးတွေက

and village elders,

သဘာပတိအဖြစ်ဆောင်ရွက်လေ့ရှိပါတယ်။

and jirgas are often used in rural countries like Afghanistan,

ဒီလိုဆွေးနွေးပွဲတွေဟာ တရားဝင်စနစ်ကို အမြစ်တွယ်မကျေနပ်ချက်တွေရှိတဲ့

where there's deep-seated resentment

ကျေးလက်ဆန်တဲ့ နိုင်ငံဖြစ်တဲ့

against the formal system.

အာဖဂန်မှာသုံးလေ့ရှိပါတယ်။

At the jirga, the men sat together

ဆွေးနွေးပွဲမှာ သူတို့က အတူထိုင်ပြီး

and they decided that the best way to satisfy the debt

Naghma ကို အိမ်နီးနားချင်းရဲ့ ၂၁နှစ်အရွယ်သားနဲ့

would be if Naghma married the neighbor's 21-year-old son.

လက်ထပ်ပေးပြီး အကြွေးဆပ်ဖို့ ဆုံးဖြတ်လိုက်ပါတယ်။

She was six.

သူမက ၆နှစ်သာ ရှိသေးတယ်။

Now, stories like Naghma's unfortunately

Naghma လို ဖြစ်ရပ်တွေက ကံမကောင်းစွာဘဲ

are all too common,

အဖြစ်များပါတယ်။

and from the comforts of our home,

ပြီးရင်ကျွန်မတို့ အိမ်မှာ စိမ်ပြေနပြေနဲ့

we may look at these stories as another

ဒီဖြစ်ရပ်တွေကို အမျိုးသမီးအရေး

crushing blow to women's rights.

ချိုးဖောက်ခံရမှုအနေနဲ့ မြင်တတ်ကြပါတယ်။

And if you watched Afghanistan on the news,

ရှင်တို့ သတင်းတွေမှာ အာဖဂန်နစ္စတန်အကြောင်း ဖတ်မိရင်

you may have this view that it's a failed state.

အဲဒီနိုင်ငံကတော့ ကျရှုံးနေပြီလို့ ထင်မိမှာပါ။

However, Afghanistan does have a legal system,

ဒါပေမဲ့လည်း အာဖဂန်မှာ တရားဥပဒေဆိုတာရှိပါတယ်။

and while jirgas are built on long-standing tribal customs,

လူမျိုးရေးဆွေးနွေးပွဲတွေဟာ ရှေးရိုး ဓလေ့ထုံးတမ်းတွေအပေါ် အခြေခံထားတဲ့အခါ

even in jirgas, laws are supposed to be followed,

ဒီဆွေးနွေးပွဲတွေမှာ ဥပဒေကို လိုက်နာဖို့လိုပါတယ်။

and it goes without saying

ပြီးရင် အကြွေးဆပ်ဖို့အတွက်

that giving a child to satisfy a debt

ကလေးကို ပေးတဲ့ဆိုတာ အကျင့်ပျက်ပြားရုံတင်မက

is not only grossly immoral, it's illegal.

တရားမဝင်ဘူးဆိုတာလည်း ပြောစရာမလိုပါဘူး။

In 2008, I went to Afghanistan

၂၀၀၈ တုန်းက ကျွန်မ အာဖဂန်နစ္စတန်ကို

for a justice funded program,

ထောက်ပံ့ကြေးရထားတဲ့ တရားဥပဒေ သင်ကြား ပို့ချရေးအတွက် သွားခဲ့ပါတယ်။

and I went there originally on this nine-month program

အစကတော့ကျွန်မ အာဖဂန်ရှေ့နေတွေကို

to train Afghan lawyers.

In that nine months, I went around the country

and I talked to hundreds of people that were locked up,

and I talked to many businesses

that were also operating in Afghanistan.

And within these conversations,

I started hearing the connections

လုပ်ငန်းတွေနဲ့ လူတွေကြား ဆက်နွယ်မှုတွေ

between the businesses and the people,

တရားမဝင်ကြမ်းတမ်းတဲ့ ဒဏ်ခတ်မှုတွေကို

and how laws that were meant to protect them

အလွန်အကျွံ သုံးချနေတဲ့အချိန်မှာ

were being underused,

လူတွေကို ကာကွယ်ပေးရမယ့် ဥပဒေတွေကို

while gross and illegal punitive measures were overused.

သိပ်အသုံးမချတာတွေကို သိရှိလာပါတယ်။

And so this put me on a quest for justness,

ဒါကြောင့် ကျွန်မ တရားမျှတမှုအတွက် စတင် စွန့်စားပါတော့တယ်။

and what justness means to me

ကျွန်မအတွက်တော့ တရားမျှတမှုဆိုတာ

is using laws for their intended purpose,

ဥပဒေတွေကို သူတို့ရဲ့ ရည်ရွယ်ချက် အတိုင်း အသုံးချတာ ဖြစ်ပါတယ်။

which is to protect.

ကာကွယ်ဖို့အတွက်ပေါ့။

The role of laws is to protect.

So as a result, I decided to open up a private practice,

ဒါကြောင့် ကျွန်မ ကိုယ်ပိုင်ရှေ့နေလုပ်ငန်း ဖွင့်လှစ်ဖို့ ဆုံးဖြတ်လိုက်ပါတယ်။

and I became the first foreigner to litigate

ကျွန်မက အာဖဂန်နစ္စတန် တရားရုံးမှာ အမှုဖြေရှင်းတဲ့

in Afghan courts.

ပထမဆုံးသော နိုင်ငံခြားသူ ဖြစ်လာပါတယ်။

Throughout this time, I also studied many laws,

ဒီအချိန်တောအတွင်း ကျွန်မ များစွာသော ဥပဒေကို လေ့လာခဲ့ပါတယ်။

I talked to many people,

လူတွေနဲ့ စကားပြောခဲ့ပါတယ်။

I read up on many cases,

အမှုတွေလည်း ဖတ်ခဲ့ပါတယ်။

and I found that the lack of justness

ကျွန်မသိလိုက်ရတာက တရားမျှတမှုမရှိခြင်းက

is not just a problem in Afghanistan,

အာဖဂန်နစ္စတန် တင်မကပါဘူး

but it's a global problem.

တစ်ကမ္ဘာလုံးမှာ ဖြစ်နေတဲ့ ပြဿနာပါ။

And while I originally shied away from

အစကတော့ ကျွန်မ ဒီလူအခွင့်အရေး အမှုတွေ

representing human rights cases

ကိုယ်စားပြုတင်ပြတာကနေ ရှောင်ထွက်ခဲ့ပါတယ်။

because I was really concerned about how it would

ဘာလို့လဲဆိုတော့ ဒါတွေက ကျွန်မကို လုပ်ငန်းအရရော

affect me both professionally and personally,

I decided that the need for justness was so great

that I couldn't continue to ignore it.

And so I started representing people like Naghma

pro bono also.

Now, since I've been in Afghanistan

and since I've been an attorney for over 10 years,

I've represented from CEOs of Fortune 500 companies

to ambassadors to little girls like Naghma,

ကိုယ်စားပြုတင်ပြခဲ့တာ

and with much success.

အောင်မြင်ခဲ့ပါတယ်။

And the reason for my success is very simple:

ကျွန်မ အောင်မြင်ရတဲ့ အကြောင်းအရင်းကတော့ ရှင်းပါတယ်။

I work the system from the inside out

ကျွန်မ ဒီစနစ်ကို ခရေစေ့တွင်းကျ လုပ်ကိုင်တာဖြစ်ပြီး

and use the laws in the ways

ဥပဒေကို သူတို့

that they're intended to be used.

ရည်ရွယ်ချက်အတိုင်း အသုံးချလို့ပါ။

I find that

အာဖဂန်နစ္စတန်လို နေရာမှာ

achieving justness in places like Afghanistan

တရားမျှတမှုရဖို့ ခက်ခဲတယ်ဆိုတာ ကျွန်မသိရှိရပါတယ်။

is difficult, and there's three reasons.

အဲဒါ အကြောင်းအရင်း ၃ခု ရှိတယ်။

The first reason is that simply put,

ပထမကတော့ ရှင်းရှင်းပြောရရင်

people are very uneducated as to what their legal rights were,

လူတွေက သူတို့ရဲ့ အခွင့်အရေး ဘာတွေလဲဆိုတာ အသိပညာ မရှိကြဘူး။

and I find that this is a global problem.

ဒါက ကမ္ဘာလုံးဆိုင်ရာ ပြဿနာဆိုတာလဲ ကျွန်မသိရှိထားတယ်။

The second issue

ဒုတိယကတော့

is that even with laws on the books,

စာအုပ်တွေမှာ ဥပဒေတွေ ပြဌာန်းထားတယ် ဆိုပေမဲ့လည်း

it's often superseded or ignored

လူမျိုးရေး ဓလေ့ထုံးတမ်းတွေကြောင့်

by tribal customs, like in the first jirga

လစ်လျုရှု ဘေးဖယ်ခံထားရပါတယ် Naghmaကို ရောင်းဖို့လုပ်တဲ့

that sold Naghma off.

ပထမ ဆွေးနွေးပွဲလိုမှာမျိုးပေါ့။

And the third problem with achieving justness

တတိယတစ်ခုကတော့

is that even with good, existing laws on the books,

ကောင်းတဲ့ဥပဒေတွေ စာအုပ်တွေမှာ ရှိပေမဲ့လည်း

there aren't people or lawyers that are willing to fight

ဒီတရားဥပဒေအတွက် တိုက်ခိုက်ပေးမယ့် လူတွေ

for those laws.

ရှေ့နေတွေ မရှိဘူး။

And that's what I do: I use existing laws,

ပြီးရင် ဒါက ကျွန်မ လုပ်နေတာလည်းဖြစ်တယ်လေ။ ကျွန်မက ရှိနေတဲ့

often unused laws,

များသောအားဖြင့် မသုံးရသေးတဲ့ ဥပဒေကို သုံးတယ်။

and I work those to the benefits of my clients.

ပြီးရင် ကျွန်မ အမှုသည်တွေ ကောင်းကျိုးအတွက် ဆောင်ရွက်တယ်။

We all need to create a global culture

ကျွန်မတို့အားလုံး လူ့အခွင့်အရေးအတွက်

of human rights

ကမ္ဘာလုံးဆိုင်ရာ ဓလေ့ထုံးတမ်းကို ဖန်တီးဖို့လိုသလို

and be investors in a global human rights economy,

ကမ္ဘာလုံးဆိုင်ရာ စီးပွားရေးမှာ ရင်းနှီး မြုပ်နှံဖို့လည်း လိုပါတယ်။

and by working in this mindset,

ဒီလို စိတ်ဓာတ်မျိုးနဲ့ လုပ်ပေးရင်းနဲ့

we can significantly improve justice globally.

တစ်ကမ္ဘာလုံး တရားမျှတမှုကို ပိုကောင်းအောင် ကျွန်မတို့လုပ်နိုင်မှာပါ။

Now let's get back to Naghma.

Naghma အကြောင်းဆီ ပြန်သွားရအောင်

Several people heard about this story,

လူတချို့ ဒီအကြောင်းကို ကြားကြတယ်။

and so they contacted me because they wanted

ဒါကြောင့် သူတို့ ကျွန်မကိုဆက်သွယ်တယ်

to pay the $2,500 debt.

အကြောင်းက ဒီ ဒေါ်လာ၂၅၀၀ အကြွေးကို ဆပ်ပေးချင်လို့ပေါ့။

And it's not just that simple;

ဒါက ဒီလောက် မရိုးရှင်းဘူးလေ။

you can't just throw money at this problem

ပိုက်ဆံ ပစ်ပေးလိုက်ရုံနဲ့ ပြဿနာက

and think that it's going to disappear.

ဖြေရှင်းသွားမှာမဟုတ်ဘူး။

That's not how it works in Afghanistan.

အာဖဂန်နစ္စတန်မှာ ဒီလိုလုပ်လို့မရဘူးလေ။

So I told them I'd get involved,

ဒါကြောင့် ကျွန်မကော ပါဝင်မယ်လို့ သူတို့ကို ပြောလိုက်တယ်။

but in order to get involved, what needed to happen

ဒါပေမဲ့ အဲဒါအတွက်ကတော့

is a second jirga needed to be called,

လူမျိုးရေး ဆွေးနွေးပွဲ ပြန်ခေါ်ဖို့လိုပါတယ်။

a jirga of appeals.

မေတ္တာရပ်ခံတဲ့ ဆွေးနွေးပွဲပေါ့။

And so in order for that to happen,

ဒါဖြစ်မြောက်ဖို့ အတွက်ဆိုရင်

we needed to get the village elders together,

ရွာလူကြီးတွေ

we needed to get the tribal leaders together,

လူမျိုးစု ခေါင်းဆောင်တွေ ဘာသာရေး ခေါင်းဆောင်တွေ

the religious leaders.

ပါဝင်ဖို့ လိုပါတယ်။

Naghma's father needed to agree,

Naghma ရဲ့ အဖေ သဘောတူဖို့လိုသလို

the neighbor needed to agree,

အိမ်နီးနားချင်း နဲ့

and also his son needed to agree.

သူ့ရဲ့ သားကော သဘောတူဖို့လိုပါတယ်။

And I thought, if I'm going to get involved in this thing,

ကျွန်မ စဉ်းစားလိုက်တာက ကျွန်မကော ပါဝင်မယ်ဆိုရင်

then they also need to agree that I preside over it.

ကျွန်မက သဘာပတိ အဖြစ်ဆောင်ရွက်မယ် ဆိုတာကိုကော သဘောတူဖို့လိုပါတယ်။

So, after hours of talking

နာရီပေါင်းများစွာ စကားပြော၊

and tracking them down,

ခြေရာခံလိုက်ပြီး

and about 30 cups of tea,

လက်ဖက်ရည်အခွက် ၃၀ သောက်ပြီးနောက်

they finally agreed that we could sit down

ကျွန်မတို့ ဒုတိယဆွေးနွေးပွဲလုပ်ဖို့ နောက်ဆုံးတော့

for a second jirga, and we did.

သူတို့တွေ သဘောတူလိုက်ပါတယ်။ ပြီးရင် ကျွန်မတို့ လုပ်ခဲ့ပါတယ်။

And what was different about the second jirga

ဒီဒုတိယတစ်ခေါက် ခြားနားတာက

is this time, we put the law at the center of it,

ကျွန်မတို့တွေ ဥပဒေကို အလယ်ဗဟိုမှာ ထားတာဖြစ်ပါတယ်။

and it was very important for me

ကျွန်မအတွက် အရမ်းအရေးကြီးတာက

that they all understood that Naghma

သူတို့အားလုံး Naghma မှာ အကာအကွယ်ရဖို့

had a right to be protected.

အခွင့်အရေး ရှိတယ်ဆိုတာ နားလည်ပါတယ်ဆိုတာ ဖြစ်ပါတယ်။

And at the end of this jirga,

ဆွေးနွေးပွဲ အဆုံးမှာတော့

it was ordered by the judge

တရားသူကြီးက အမိန့်ပေးလိုက်ပါတယ်။

that the first decision was erased,

ပထမ ဆုံးဖြတ်ချက်ကို ပယ်ဖျက်လိုက်ပြီ

and that the $2,500 debt was satisfied,

၂၅၀၀ အကြွေးလည်း ကျေအေးသွားပြီ

and we all signed a written order

အားလုံး ရေးထားတဲ့အမိန့်စာမှာ လက်မှတ်ထိုးလိုက်ပါတယ်။

where all the men acknowledged

ဒီလူတွေအားလုံးက

that what they did was illegal,

သူတို့ လုပ်တာတွေဟာ တရားမဝင်တာရယ်

and if they did it again, that they would go to prison.

သူတို့ ထပ်လုပ်ရင်လည်း ထောင်ကျနိုင်တယ် ဆိုတာကို အသိမှတ်ပြုကြောင်းပေါ့။

Most —

And most importantly,

the engagement was terminated

and Naghma was free.

Protecting Naghma and her right to be free

Naghma ရယ် သူမ လွတ်လပ်ဖို့ အခွင့်အရေးကို ကာကွယ်တာဟာ

protects us.

ကျွန်မတို့ကို ကာကွယ်ရာ ရောက်ပါတယ်။

Now, with my job, there's above-average

အခု ကျွန်မ အလုပ်နဲ့အတူ ပျမ်းမျှထက်ပိုတဲ့

amount of risks that are involved.

အရဲစွန့်တာလေးတွေ ရှိပါတယ်။

I've been temporarily detained.

ကျွန်မ ယာယီ ချုပ်နှောင်ခံရပါတယ်။

I've been accused of running a brothel,

ပြည့်တန်ဆာအိမ် ဖွင့်လှစ်ထားတယ်လို့

accused of being a spy.

သူလျှိုတစ်ယောက် ဖြစ်တယ်လို့ အစွပ်စွဲခံရပါတယ်။

I've had a grenade thrown at my office.

ကျွန်မ ရုံးကော ဗုံးနဲ့ ပစ်ခံရတယ်လေ

It didn't go off, though.

မပေါက်ကွဲပါဘူး။

But I find that with my job,

ဒါပေမဲ့ ဆုလာဒ်တွေက

that the rewards far outweigh the risks,

အရဲစွန့်တာထက် ပိုတာကို ကျွန်မ သိလိုက်ရပါတယ်။

and as many risks as I take,

ကျွန်မ အရဲစွန့်တာနဲ့အမျှ

my clients take far greater risks,

ကျွန်မ အမှုသည်တွေ ပိုပြီး အရဲစွန့်ရပါတယ်။

because they have a lot more to lose

အကြောင်းက သူတို့အမှုကို လူတွေမသိကြရင်

if their cases go unheard,

သူတို့မှာ ဆုံးရှံးစရာအများကြီးပါ။

or worse, if they're penalized for having me as their lawyer.

With every case that I take,

ကျွန်မဖြေရှင်းပေးတဲ့ အမှုတိုင်းမှာ

I realize that as much as I'm standing behind my clients,

ကျွန်မသိလိုက်တာက ကျွန်မ အမှုသည်တွေကို ကျွန်မ ထောက်ခံနေသလလို

that they're also standing behind me,

သူတို့လည်း ကျွန်မကို ထောက်ခံပေးနေတယ်လေ။

and that's what keeps me going.

Law as a point of leverage

is crucial in protecting all of us.

Journalists are very vital in making sure

that that information is given to the public.

Too often, we receive information from journalists

မကြာမကြာပါဘဲ ကျွန်မတို့တွေ သတင်းတွေ ရတယ်။

but we forget how that information was given.

ဒါပေမဲ့ ကျွန်မတို့တွေ ဒီသတင်းတွေကို ဘယ်လို ရခဲ့လဲဆိုတာ မေ့နေတက်ကြပါတယ်။

It was taken a couple of years ago by my friend David Gill.

According to the Committee to Protect Journalists,

since 2010, there have been thousands of journalists

၂၀၁၀ ကတည်းက ထောင်ပေါင်းများစွာသော သတင်းထောက်တွေက

who have been threatened, injured,

အခြိမ်းခြောက်ခံရ၊ ဒဏ်ရာပေးခံရ၊

killed, detained.

အသတ်ခံရပြီ ချုပ်နှောင်ခံရကြပါတယ်။

Too often, when we get this information,

မကြာမကြာ ကျွန်မတို့ သတင်းတွေရတဲ့အချိန်မှာ

we forget who it affects

ဒါက ဘယ်သူကို သက်ရောက်လဲ

or how that information is given to us.

သတင်းတွေ ဘယ်လိုရလာလဲဆိုတာ ကျွန်မတို့တွေ မေ့နေကြပါတယ်။

What many journalists do, both foreign and domestic,

များစွာသော ပြည်တွင်း၊ ပြည်ပ သတင်းထောက်တ​ွေ လုပ်နေတာက

is very remarkable, especially in places like Afghanistan,

မှတ်သားလောက်ပါတယ်။ အထူးသဖြင့် အာဖဂန်နစ်စတန်လို့ နေရာမှာပေါ့။

and it's important that we never forget that,

ဒါကြောင့်ကျွန်မတို့ ဒါကိုမမေ့ဖို့လိုပါတယ်။

because what they're protecting

အကြောင်းက သူတို့ ကာကွယ်နေတာ

is not only our right to receive that information

ကျွန်မတို့ရဲ့ သတင်းရယူပိုင်ခွင့် တင်မကပါဘူး

but also the freedom of the press, which is vital

သတင်းထုတ်ဖို့အတွက် လွတ်လပ်ခွင့်တွေကောပေါ့။

to a democratic society.

အဲဒါက ဒီမိုကရေစီ လူအဖွဲ့အစည်း အတွက် အရမ်းအရေးကြီးတယ်လေ။

Matt Rosenberg is a journalist in Afghanistan.

and unfortunately, a few months ago

he wrote an article that displeased

As a result, he was temporarily detained

and he was illegally exiled out of the country.

I represent Matt,

and after dealing with the government,

အစိုးရနဲ့ ဖြေရှင်းပြီးတာနဲ့

I was able to get legal acknowledgment

တရားဝင် အသိအမှတ်ပြုမှုကို ရခဲ့ပါတယ်

that in fact he was illegally exiled,

and that freedom of the press does exist in Afghanistan,

and there's consequences if that's not followed.

And I'm happy to say that

ကျွန်မ ပြောချင်တာက

as of a few days ago,

လွန်ခဲ့တဲ့ ရက်အနည်းငယ်က

the Afghan government

အာဖဂန်နစ္စတန် အစိုးရက

formally invited him back into the country

သူကို နိုင်ငံထဲ တရားဝင်ဖိတ်ခေါ်ခဲ့ပြီး

and they reversed their exile order of him.

ပြည်နှင်ဒဏ် အမိန့်ကိုလည်း ပယ်ဖျက်ခဲ့ပါတယ်။

If you censor one journalist, then it intimidates others,

သတင်းထောက်တစ်ယောက်ကို ဆင်ဆာဖြတ်ရင် တစ်ခြားသူတွေကိုပါ ခြောက်လှန့်ရာရောက်ပါတယ်

and soon nations are silenced.

မကြာခင်မှာ နိုင်ငံသားတွေက တိတ်ဆိတ်လာပါတယ်။

It's important that we protect our journalists

ဒါကြောင့် သတင်းထောက်တွေကော သတင်းထုတ်ဖို့ လွတ်လပ်ခွင့်ကိုပါ

and freedom of the press,

ကာကွယ်ဖို့ အရေးကြီးပါတယ်။

because that makes governments more accountable to us

ဒါမှသာ အစိုးရက တာဝန်ယူမှာဖြစ်သလို

and more transparent.

ရှင်းလင်း မြင်သာလာမှာလည်း ဖြစ်ပါတယ်။

Protecting journalists and our right

သတင်းထောက်တွေနဲ့ ကျွန်မတို့

to receive information protects us.

သတင်းရပိုင်ခွင့်ကို ကာကွယ်တာဟာ ကျွန်မတို့ကို ကာကွယ်ရာ ရောက်ပါတယ်။

Our world is changing. We live in a different world now,

ကျွန်မတို့ ကမ္ဘာဟာ ပြောင်းလဲနေပါပြီ။ ကျွန်မတို့ အခု မတူညီတဲ့ ကမ္ဘာမှာနေနေတာပါ။

and what were once individual problems

လူတစ်ဦးစီ ပြဿနာက ကျွန်မတို့အားလုံးအတွက်

are really now global problems for all of us.

တစ်ကမ္ဘာလုံးဆိုင်ရာ ပြဿနာဖြစ်ပါတယ်။

Two weeks ago, Afghanistan had its first

လွန်ခဲ့တဲ့ နှစ်ပတ်က အာဖဂန်နစ္စတန် ပထမဆုံးအကြိမ်

democratic transfer of power

ဒီမိုကရေစီ အာဏာလွဲပြောင်းခဲ့ပြီး

and elected president Ashraf Ghani, which is huge,

Ashraf Ghani ကို သမ္မတအဖြစ် ရွေးခဲ့ပါတယ်။ အဲဒါက ကြီးမားတယ်လေ။

and I'm very optimistic about him,

ပြီးရင် ကျွန်မ သူနဲ့ပတ်သတ်ပြီး အကောင်းမြင်ပါတယ်

and I'm hopeful that he'll give Afghanistan

အာဖဂန်နစ္စတန်အတွက် လိုအပ်တဲ့ ပြောင်းလဲမှုတွေ

the changes that it needs,

ယူဆောင်ပေးမယ်လို့လဲ မျှော်လင့်ပါတယ်

especially within the legal sector.

အထူးသဖြင့် ဥပဒေကဏ္ဍမှာပေါ့။

We live in a different world.

ကျွန်မတို့ အခု မတူညီတဲ့ ကမ္ဘာမှာနေနေတာပါ။

We live in a world where my eight-year-old daughter

ကျွန်မတို့ နေတဲ့ ကမ္ဘာမှာ ကျွန်မ ၈ နှစ်သမီးက

only knows a black president.

လူမည်းသမ္မတ တစ်ယောက်ကိုဘဲ သိပါတယ်။

There's a great possibility that our next president

ကျွန်မတို့ နောက်သမ္မတက အမျိုးသမီး

will be a woman,

ဖြစ်နိုင်ခြေက များတယ်လေ။

and as she gets older, she may question,

သူမက ကြီးလာတဲ့နဲ့အမျှ မေးခွန်း မေးလာနိုင်ပါတယ်။

can a white guy be president?

လူဖြူကောင်လေးကော သမ္မတ ဖြစ်လို့ရလားပေါ့။

Our world is changing, and we need to change with it,

and what were once individual problems

လူတစ်ဦးစီပြဿနာက ကျွန်မတို့

are problems for all of us.

According to UNICEF,

UNICEF အရ

there are currently over 280 million

လက်ရှိ အသက် ၁၅ နှစ်မပြည့်ဘဲ

boys and girls who are married

လက်ထပ်ထားတဲ့ ယောက်ျားလေး

under the age of 15.

မိန်းကလေး သန်း ၂၈၀ ရှိပါတယ်။

Two hundred and eighty million.

သန်း၂၈၀ တောင်။

Child marriages prolong the vicious cycle

ကလေးငယ်ထိမ်းမြားခြင်းက ဆင်းရဲမှု၊

of poverty, poor health, lack of education.

ကျန်းမာရေးချို့တဲ့မှု၊ ပညာချို့တဲ့မှု သံသရာကို ရှည်ကြာစေပါတယ်။

At the age of 12, Sahar was married.

အသက် ၁၂နှစ်မှာ Sahar ဟာ အိမ်ထောင်ကျသွားပြီ ဖြစ်ပါတယ်။

She was forced into this marriage

သူမအစ်ကိုက သူမကို ရောင်းချပြီး

and sold by her brother.

ဒီမင်္ဂလာပွဲထဲကို သွတ်သွင်းခဲ့တာဖြစ်ပါတယ်။

When she went to her in-laws' house,

သူမ ခင်ပွန်းအိမ်ရောက်တော့

they forced her into prostitution.

သူတို့က သူမကို ပြည့်တန်ဆာအဖြစ် သွတ်သွင်းပါတယ်။

Because she refused, she was tortured.

သူမက ငြင်းဆန်တဲ့အတွက် အနှိပ်စက်ခံရပါတယ်။

She was severely beaten with metal rods.

သူမကို သံချောင်းနဲ့ ပြင်းထန်စွာ ရိုက်ပါတယ်။

They burned her body.

သူမကို မီးနဲ့ရှို့ပါတယ်။

They tied her up in a basement and starved her.

ပြီးရင် သူမကို မြေအောက်ခန်းမှာ ချုပ်ထားပြီး အငတ်ထားပါတယ်။

They used pliers to take out her fingernails.

ပြီးရင် သူမ လက်သည်းတွေကို ပလက်ယာနဲ့ နှုတ်ပါတယ်။

At one point,

တစ်ချိန်မှာတော့

she managed to escape from this torture chamber

သူမက နှိပ်စက်အခန်းကနေ လွတ်မြောက်ပြီး

to a neighbor's house,

အိမ်နီးနားချင်းဆီ ရောက်သွားပါတယ်။

and when she went there, instead of protecting her,

အဲကိုရောက်တော့ သူမကို ကာကွယ်ရမယ့်အစား

they dragged her back

သူတို့က သူမကို ခင်ပွန်းဖြစ်သူအိမ်ဆီကို

to her husband's house,

ပြန်ဆွဲခေါ်သွားပါတယ်။

and she was tortured even worse.

ပြီးရင် သူမက ဒီထက်မက နှိပ်စက်ခံရပါတော့တယ်။

When I met first Sahar, thankfully,

Sahar ကို ကျွန်မ ပထမဆုံးအကြိမ် တွေ့တော့ ကံကောင်းစွာဘဲ

Women for Afghan Women

အာဖဂန်အမျိုးသမီးအဖွဲ့က

gave her a safe haven to go to.

သူမနေဖို့ လုံခြုံတဲ့နေရာလေး တစ်ခုပေးထားပါတယ်။

As a lawyer, I try to be very strong

ရှေ့နေတစ်ယောက် အနေနဲ့ ကျွန်မ အမှုသည် အားလုံးအတွက်

for all my clients,

စိတ်ကြံခိုင်ဖို့ ကြိုးစားပါတယ်။

because that's very important to me,

ဒါက ကျွန်မအတွက် အရေးကြီးလို့လေ။

but seeing her,

ဒါပေမဲ့ သူမဒီလို

how broken and very weak as she was,

အားနည်း ကျိုးပဲ့နေတာ တွေ့တော့

was very difficult.

အလွန် ခက်ခဲပါတယ်။

It took weeks for us to really get to

သူမ အဲဒီအိမ်မှာ ရှိတုန်းလေး

what happened to her

ဖြစ်ပျက်ခဲ့တာတွေ သိရဖို့

when she was in that house,

အပတ်အနည်းငယ် ကြာခဲ့ပါတယ်။

but finally she started opening up to me,

ဒါပေမဲ့ နောက်ဆုံး သူမ ကျွန်မကို ဖွင့်ဟ ပြောဆိုလာပါတယ်။

and when she opened up,

သူမ ဖွင့်ဟပြောတဲ့အခါ

what I heard was

ကျွန်မ သိလိုက်တာက

she didn't know what her rights were,

သူမမှာ ဘာအခွင့်အရေးတွေ ရှိတယ်ဆိုတာ သူမ မသိဘူး။

but she did know she had a certain level of protection

ဒါပေမဲ့ အစိုးရ မပေးစွမ်းနိုင်ခဲ့တဲ့

by her government that failed her,

အကာအကွယ်ကိုတော့ သူမ ရပိုင်ခွင့် ရှိတယ်ဆိုတာ သူမ သိပါတယ်။

and so we were able to talk about

ဒါကြောင့် ကျွန်မတို့တွေ သူမမှာ

what her legal options were.

ဘာတွေ ရွေးချယ်ခွင့်ရှိတယ်ဆိုတာ ဆွေးနွေးနိုင်ခဲ့ပါတယ်။

And so we decided to take this case

ကျွန်မတို့ ဒီအမှုကို တရားရုံးကြီးကို

to the Supreme Court.

တင်ပြဖို့ ဆုံးဖြတ်လိုက်ပါတယ်။

Now, this is extremely significant,

အခု ဒါက အင်မတန် အရေးကြီးပါတယ်။

because this is the first time

ဘာလို့လဲဆိုတော့ ဒါက ပထမဆုံးအကြိမ်

that a victim of domestic violence in Afghanistan

အာဖဂန်နစ္စတန်က အိမ်တွင်းအကြမ်းဖက် အမှုသည်ကို

was being represented by a lawyer,

ရှေ့နေတစ်ယောက်နဲ့ ကိုယ်စားပြု တင်ပြတာ ဖြစ်ပါတယ်။

a law that's been on the books for years and years,

ဥပဒေက စာအုပ်ထဲမှာ နှစ်ပေါင်းများစွာရှိခဲ့တာ

but until Sahar, had never been used.

Sahar မတိုင်ခင်ထိ အသုံးချခြင်း မရှိခဲ့ပါဘူး။

In addition to this, we also decided

ဒါ့အပြင် ကျွန်မတို့တ​ွေ နစ်နားကြေး အတွက်ကော

to sue for civil damages,

တရားစွဲဖို့ ဆုံးဖြတ်လိုက်ပါတယ်။

again using a law that's never been used,

တစ်ခေါက်မှ မသုံးရသေးတဲ့ ဥပဒေကို သုံးပြီးတော့ပေါ့။

but we used it for her case.

ဒါပေမဲ့ ကျွန်မတို့ သူမ အမှု အတွက် သုံးတာဖြစ်ပါတယ်။

So there we were at the Supreme Court

ကျွန်မတို့တွေ တရားရုံးကြီးမှာ

arguing in front of 12 Afghan justices,

အာဖဂန် ရှေ့နေ ၁၂ ယောက်ရှေ့ ငြင်းခုံခဲ့ပါတယ်။

me as an American female lawyer,

ကျွန်မကတော့ အမေရိကန် အမျိုးသမီးရှေ့နေတစ်ယောက်ပေါ့။

and Sahar, a young woman

Sahar က အသက်ငယ် အမျိုးသမီးပါ။

who when I met her couldn't speak above a whisper.

ကျွန်မ သူမ ကိုစတွေ့တော့ သူမက စကားတိုးတိုးလေးဘဲ ပြောနိုင်ခဲ့တာပါ။

She stood up,

နောက်ဆုံးတော့ သူမက မတ်တပ်ရပ်ပြီး

she found her voice,

အသံ ထွက်ဆိုလာပါတယ်။

and my girl told them that she wanted justice,

သူမက တရားမျှတမှု လိုချင်ကြောင်း သူတို့ကို ပြောလိုက်ပါတယ်။

and she got it.

ပြီးရင် သူမ တရားမျှတမှုကို ရရှိခဲ့ပါတယ်။

At the end of it all, the court unanimously agreed

အဆုံးမှာတော့ တရားရုံက အကန့်ကွက်မရှိ သဘောတူလိုက်ပါတယ်။

that her in-laws should be arrested for what they did to her,

သူမ ခင်ပွန်းနဲ့ မိသားစုက သူမအပေါ် ပြုလုပ်ခဲ့တာတွေ အတွက်အဖမ်းခံသင့်တယ်ဆိုတာရယ်

her fucking brother should also be arrested

သူမရဲ့ အစုတ်ပလုတ် အစ်ကိုကော သူမကို ရောင်းစားတဲ့အတွက်

for selling her —

အဖမ်းခံသင့်တယ် ဆိုတာကိုရောပေါ့။

and they agreed that she did have a right

ပြီးရင် သူမမှာ နစ်နာကြေးရပိုင်ခွင့်

to civil compensation.

ရှိတယ်ဆိုတာကိုရော သဘောတူလိုက်ပါတယ်။

What Sahar has shown us is that we can attack

Sahar ကျွန်မတို့ကို ပြသလိုက်တာက ကျွန်မတို့တွေ မကောင်းတဲ့

existing bad practices by using the laws

လုပ်ရပ်တွေကို ဥပဒေတွေကို သူတို့ရဲ့ ရည်ရွယ်ချက်အတိုင်း

in the ways that they're intended to be used,

အသုံးပြုပြီး ပယ်ဖျက်လို့ရတယ် ဆိုတာဖြစ်ပါတယ်။

and by protecting Sahar,

Sahar ကိုကာကွယ်ရင်းနဲ့

we are protecting ourselves.

ကျွန်မတို့ကိုယ့်ကို ကာကွယ်ရာရောက်ပါတယ်။

After having worked in Afghanistan

အာဖဂန်နစ္စတန်မှာ ၆နှစ်ကျော်

for over six years now,

အလုပ်လုပ်ပြီးနောက်

a lot of my family and friends think

ကျွန်မ မိသားစုနှင့် မိတ်ဆွေတွေက

that what I do looks like this.

ကျွန်မ လုပ်နေတာက ဒါနဲ့ တူတယ်လို့ ထင်ကြတယ်။

But in all actuality, what I do looks like this.

တကယ်ကြတော့ ဒါနဲ့ပိုတူတာပါ။

Now, we can all do something.

ကျွန်မတို့ တစ်ခုခု လုပ်ပေးလို့ရတယ်လေ။

I'm not saying we should all buy a plane ticket and go to Afghanistan,

ကျွန်မတို့ လေယာဉ်လတ်မှတ် ဝယ်ပြီး အာဖဂန်ကို သွားရမယ်လို့ ပြောနေတာမဟုတ်ဘူး။

but we can all be contributors

ကျွန်မတို့အားလုံး ကမ္ဘာလုံးဆိုင်ရာ လူအခွင့်အရေးအတွက်

to a global human rights economy.

စီးပွားရေးလုပ်ငန်းကို ထောက်ပံ့ပေးနိုင်ပါတယ်။

We can create a culture of transparency

ကျွန်မတို့တွေ ရှင်းလင်းမြင်သာတဲ့ ဥပဒေအရ တာဝန်ယူတတ်တဲ့

and accountability to the laws,

ဓလေ့ထုံးတမ်းကိုဖန်တီးနိုင်ပြီးတော့

and make governments more accountable to us,

ကျွန်မတို့က အစိုးရ အပေါ် တာဝန်ယူသလို

as we are to them.

သူတို့ ကျွန်မတို့ အပေါ် တာဝန် ပိုယူအောင် လုပ်နိုင်ပါတယ်။

A few months ago, a South African lawyer

လွန်ခဲ့တဲ့ လအနည်းငယ်က တောင်အာဖရိက ရှေ့နေတစ်ယောက်

visited me in my office

ကျွန်မရုံးကို အလည်လာခဲ့ပါတယ်။

and he said, "I wanted to meet you.

သူကပြောတယ် "ငါ မင်းကို တွေ့ချင်လိုက်တာ။

I wanted to see what a crazy person looked like."

ရူးမိုက်နေတဲ့ လူက ဘာနဲ့ တူလဲဆိုတာ ငါသိချင်လိုက်တာ"။

The laws are ours,

ဥပဒေကို ကျွန်မတို့ ပိုင်ပါတယ်။

and no matter what your ethnicity,

ရှင်ရဲ့ လူမျိုး၊ နိုင်ငံသား၊ ကျားမ၊

nationality, gender, race,

တိုင်းရင်းသား ဘာပဲဖြစ်ဖြစ်

they belong to us,

ဥပဒေကို ကျွန်မတို့ ပိုင်ပါတယ်။

and fighting for justice is not an act of insanity.

တရားမျှတဖို့အတွက် တိုက်ခိုက်တာဟာ ရူးသွပ်ခြင်း လုပ်ရပ် မဟုတ်ပါဘူး။

Businesses also need to get with the program.

လုပ်ငန်းတွေလည်း ဒီအစီအစဉ်ထဲ ပါဝင်ဖို့လိုပါတယ်။

A corporate investment in human rights

လူအခွင့်အရေးအတွက် ရင်းနှီးမြုပ်နှံတာဟာ

is a capital gain on your businesses,

စီးပွားရေးလုပ်ငန်းမှာ အကျိုးအမြတ်ရစေပါတယ်။

and whether you're a business, an NGO,

ရှင်က လုပ်ငန်းရှင်၊ NGO၊

or a private citizen, rule of law benefits all of us.

နိုင်ငံသား ဘာပဲဖြစ်ဖြစ် တရားဥပဒေက ကျွန်မတို့အားလုံးကို အကျိုးပြုပါတယ်။

And by working together with a concerted mindset,

ဒီလို ညီညွတ်တဲ့ စိတ်ထားမျိုးနဲ့ အတူတူလုပ်ရင်

through the people, public and private sector,

လူထု၊ ပြည်သူ နှင့် ကိုယ်ပိုင် ကဏ္ဍမှာပေါ့

we can create a global human rights economy

ကျွန်မတို့ လူအခွင့်အရေး စီးပွားရေးကို ဖန်တီးနိုင်မှာဖြစ်ပြီး

and all become global investors in human rights.

အားလုံးဘဲ လူအခွင့်အရေးမှာ ရင်းနှီးမြုပ်နှံသူတွေ ဖြစ်လာနိုင်ပါတယ်။

And by doing this,

ဒီလို လုပ်ခြင်းဖြင့်

we can achieve justness together.

ကျွန်မတို့ တရားမျှတမှုကို အတူတကွ ရယူနိုင်မှာပါ။
