You’re falling prey to a type of argument from ignorance:

assuming that a claim is true because it hasn’t been proven false.

거짓으로 입증되지 않았으니 사실이라 추정하는 거죠.

The claim being Senator McCarthy’s accusations against Judge Kenyon,

매카시 상원 의원은 케니언 판사의 혐의를 제기하며

for which he provided no legitimate evidence.

합당한 증거를 제시하지 않았습니다.

Is that right? I thought so.

Some of the so-called communist organizations he accused her of joining

케니언이 가입했다고 비난받은 이른바 공산주의 단체 중 일부는

don’t even exist.

실제 존재하지도 않아요.

To assume a claim is true because it hasn’t been proven false

거짓이라 입증되지 않았기 때문에 사실이라고 가정하는 것은

ignores many other possibilities:

다른 많은 가능성을 배제하죠.

that it hasn’t been proven false yet, that it can’t be proven true or false,

즉, 아직 거짓으로 입증되지 않았거나 사실 또는 거짓을 입증할 수 없거나

or that it isn’t completely true or completely false, to name a few.

완전히 사실이 아니거나 완전히 거짓이 아닐 수도 있어요.

This leads to a handy rule of thumb:

the burden of proof lies with the person making the claim.

‘주장하는 사람이 입증 책임을 진다.’

In other words, you make the claim, you supply the proof.

즉, 어떤 주장을 하려면 증거도 제시해야 합니다.

If someone told you aliens exist,

would you head off to find proof that they don’t exist?

외계인이 존재하지 않는다는 증거를 찾아 나설 건가요?

Of course not.

You’d tell that person to show you the UFO.

그런 말을 한 사람에게 UFO를 보여달라고 하겠죠.

The same applies when someone makes a claim

누군가가 확립된 합의에 반하는 주장을 할 때에도 마찬가지입니다.

that contradicts an established consensus.

So when all the available evidence suggests

얻을 수 있는 모든 증거가

that humans are causing an increase in global temperatures,

인류가 지구의 온도를 올린다고 시사한다면

the burden of proof has been fulfilled—

입증 책임이 충족된 거예요.

if you disagree, it becomes your responsibility to prove otherwise.

이에 동의하지 않는다면 그렇지 않단 증명은 여러분 몫이에요.

Right?

Anyway, your legal system supposedly recognizes this rule—
