Suddenly, you are pulled over.

During the stop, the officer asks,

A few days later,

the local district attorney files paperwork to keep your money --

And all of this happens

Now, you might be saying,

Incidents like this occur every day in our country.

It's one of the most significant threats to your property rights

most people have never even heard of.

It's called "civil forfeiture."

"민사 몰수"라고 불립니다.

Most of you are generally aware of criminal forfeiture,

여러분 대부분은 '형사 몰수'가 무엇인지 알고 있을 것입니다.

although the term itself might be a little unfamiliar,

so let's begin with forfeiture.

When we forfeit something, we give up that thing,

or we're forced to give it up.

혹은 억지로 포기 하게 되는 상황을 의미합니다.

In criminal forfeiture,

someone is charged and convicted of a crime,

and therefore, they have to give up property related to that crime.

범죄 행위를 통해 획득한 돈 즉 범죄수익을 몰수합니다.

For example, suppose you use your car to transport and deal drugs.

예를 들어, 마약 운반과 거래에 본인의 차를 사용했다고 합시다.

You're caught and convicted;

now you have to give up or forfeit your car

That's criminal forfeiture.

But in civil forfeiture, no person is charged with a crime --

the property is charged and convicted of a crime.

재산이 기소되고 유죄 판결을 받죠.

You heard that correctly:

the government actually convicts an inanimate object with a crime.

정부는 무생물에 유죄 판결을 내립니다.

It's as if that thing itself committed the crime.

마치 그 물건이 범죄를 저지른 것 마냥 취급합니다.

That's why civil forfeiture cases have these really peculiar names,

like, "The United States of America v. One 1990 Ford Thunderbird."

Or "The State of Oklahoma v. 53,234 Dollars in Cash."

Now, you're thinking:

지금 아마 이렇게 생각하고 계실 겁니다.

How does something like this happen?

어떻게 이런 일이 일어나지?

That's exactly what I said when I first learned about civil forfeiture

제가 민사 몰수 제도에 대해서 처음 접했을 때 든 생각입니다.

while on a road trip with my wife.

아내와 여행 중이였죠.

No, we did not get pulled over.

경찰에게 정차명령을 당하거나 하진 않았습니다.

(Laughter)

I was reading about the history of civil forfeiture

법률 사무소의 연구 책임자 업무의 일환으로

as part of my work as a research director at the law firm,

민사 몰수 제도의 역사에 대한 내용을 읽던 중이었습니다.

and I came across one of the cases I just mentioned,

아까 말씀드렸던 판례 중 하나도 읽게 되었죠.

"The United States of America v. One 1990 Ford Thunderbird."

"미국 vs 1990년형 포드 선더버드" 사건 이었습니다

In that case, Carol Thomas loaned her car to her son.

그 사건에서, 캐롤 토마스는 그녀의 아들에게 차를 빌려줬습니다.

While in the car, her son committed a minor drug crime.

그런데 그 차 안에서 그녀의 아들은 마약 경범죄를 저질렀죠.

Carol didn't commit any crime,

캐롤은 그 어떤 범죄도 저지르지 않았습니다.

so law enforcement couldn't convict her and take the car,

그래서 법집행 당국은 그녀에 대해 유죄판결을 받아 차를 가져갈 수는 없었죠.

but they could -- and did --

use civil forfeiture to "convict the car" and take it.

Carol was completely innocent, but she lost her car nonetheless.

In other words,

she was punished for a crime she did not commit.

When I read this, I was gobsmacked.

How could this occur?

How is this even legal?

어떻게 이게 심지어 합법인 걸까?

It turns out, it began in our country with maritime law.

알아보니 우리나라에서는 해사법에서 시작되었더군요.

Early in our republic, the government sought to fight piracy --

공화국 초기, 정부는 해적과 싸울 방법을 찾고 있었는데요.

yes, actual pirates.

예, 진짜 해적들 말입니다.

The problem was the government often couldn't catch the pirates,

문제는 정부가 종종 해적들을 못 잡는다는 건데요.

so instead it used civil forfeiture to convict the pirates' property

대신, 민사몰수법을 이용하여 해적들의 재산에 유죄를 판결한 후

and take it,

몰수했습니다.

and therefore deny the pirates their illegal profits.

그러니 해적들의 불법적 이득을 인정하지 않았던 셈이죠.

Of course, the government could've simply taken and kept the booty

물론, 민사 몰수법을 사용하지 않고

without necessarily using civil forfeiture,

정부가 해적들의 노획물을 뺏어서 가지면 간단했을 겁니다.

but doing so would have violated

하지만 그랬으면 우리의 가장 기본적인 법 절차와 재산권을 침해하게 되었을 겁니다.

our most basic due process and property rights.

Now, the government rarely used civil forfeiture until the 1980s

정부는 1980년대 및 마약과의 전쟁 이전까지 민사 몰수법을 거의 쓰지 않았습니다.

and the war on drugs.

We expanded civil forfeiture law to cover drug crimes

마약 범죄에도 적용하기 위해 민사 몰수법의 범위를 늘린 것입니다.

and then later, other types of crime.

이후에는 다른 종류의 범죄에도 적용 시켰죠.

Canada and the European Union adopted similar provisions

캐나다와 유럽연합은 비슷한 법 조항을 사용 했습니다.

so that now all kinds of people are ensnared in the forfeiture web,

people like Russ Caswell.

러스 캐스웹이 그런 사람 중 한 명입니다.

Russ Caswell owned a small budget motel in Tewksbury, Massachusetts.

러스 캐스웰은 매사츄세츠주의 튝스베리에서 작은 저가 모텔을 소유하고 있었습니다.

His father built the motel in 1955, and Russ took it over in the 1980s.

그의 아버지가 1955년에 모텔을 지었으며 1980년대 이후 러스가 물려 받았습니다.

During the years that Russ owned the motel,

from time to time, people would rent rooms,

and they would commit drug crimes.

Russ didn't condone the activities --

in fact, whenever he found out about it, he would immediately call police.

but that did not stop the US Department of Justice from seizing his motel

But Russ's case was not alone.

And we're not necessarily talking about major drug kingpins

or headline-grabbing financial fraudsters

whose cases involve hundreds of thousands if not millions of dollars.

Many of these seizures and forfeitures involve just everyday people

많은 몰수 및 압수 건들은 평범한 사람들에게 일어납니다.

like Russ Caswell

or me.

But it gets worse.

더 심각해지는 건 지금부터입니다.

Where does all this cash and property end up?

In most places, law enforcement keeps it.

대부분의 경우, 법 집행부가 갖게 됩니다.

And they use it to buy equipment

or pay for building repairs

or even pay salaries and overtime.

This is a clear conflict of interest.

It creates a perverse profit incentive that can distort law enforcement.

And this is a problem that's not lost on those in law enforcement, either.

Former chief of police in Rochester, Minnesota, Roger Peterson,

described the choice that police officers often face.

suppose I'm a police officer,

So it's easy to see why a police officer might go for the cash.

It was just such a circumstance

that compelled police officers in Philadelphia to seize an entire house.

In 2014, Chris and Markela Sourovelis' son sold 40 dollars worth of drugs

down the street from their house.

Forty dollars.

The police watched the deal go down.

But the Sourovelises' case was no outlier.

that Philadelphia was running a forfeiture machine.

Philadelphia took more than 77 million dollars through forfeiture,

Cars, jewelry, electronics -- all of it they sold,

When our team first began researching forfeiture in 2007,

When forfeiture proceeds stop hitting law enforcement budgets directly,

that is when we will end policing for profit.

Now, as you can imagine,

law enforcement officials don't love these recommendations.

They stand to lose a lot of money,

it's not.

In June 2019, we released a study

So when city and county budgets are tight,

So it's no wonder, then,

But some states have already implemented them,

just doing the everyday stuff of life,

can be caught in a scheme we never thought possible.

상상치도 못했던 계략에 휘말릴 수도 있습니다.

It is time we end policing for profit

once and for all.
