Imagine a world in which China was an environmental leader.

When we hear about China,

we usually hear about human rights, trade disputes, toxic pollution.

And I'm not here to dispute the news.

Instead, what I want to do

ClientEarth, the environmental law organization that I set up,

We work as trusted partners with the Ministry of Environment.

We train judges and we train prosecutors in environmental prosecutions.

Let me share with you how this all began.

In 2014,

I was invited to Brussels to meet a group of Chinese officials.

They said they wanted to meet CEOs of Western environmental groups

because they were looking to encourage more environmental groups in China.

Shortly after that, I was invited to Beijing

by the Supreme People's Court, the highest court in the land.

The judges were working on regulations for a new law

그곳 판사들은 새로운 규제 법안을 만들고 있었고,

that would allow Chinese environmental NGOs

그 법안은 중국의 환경 비영리단체들이

to sue polluting companies,

오염물질 배출 기업을 고소하기 위한 것으로서

including those owned by the state.

They were interested in my advice

because of my extensive environmental litigation experience

in Europe and in America.

They wanted to know, they said,

what it would take to really make such a system work.

I found myself in a conference room in Beijing

with three justices of the Supreme Court

and senior officials of the Ministry of Environment

and the People's Congress, which is the Chinese parliament.

"Before we get into details," I said, "I want to compliment you.

저는 먼저 이렇게 말했죠. “본격적으로 시작하기 전에

여러분께 박수를 보내고 싶습니다.

It is amazing that you are writing a law

여러분이 이런 법안을 만든다는 게 놀랍고,

to allow Chinese environmental groups to sue polluting companies,

중국 환경단체들이 오염물질 배출 기업을 고소하고,

including those owned by the state.

그것도 공기업들을 고소할 수 있다는 게 놀랍네요.

This is revolutionary."

정말 혁명적인 일입니다.”

(Laughter)

The senior judge said, "Mr. Thornton, 'revolutionary' is a big word for us."

판사가 이러더군요.

“손튼씨, 혁명적이라는 단어는 좀 과한 것 같네요.”

(Laughter)

(웃음)

So we laughed.

그래서 우리는 웃었죠.

And in that human moment, I realized I could work with these people.

그리고 그 순간, 저는 이 사람들과 일할 수 있다는 것을 바로 깨달았죠.

He said, "Consider it a sea change."

그는 바다의 변화를 고려해야 한다고 말했습니다.

So for the next three months or so,

my team and I worked very closely with the judges,

designing recommendations for how to make the system really deliver

for citizens enforcing the law.

One of the key provisions we worked on involved costs.

Now, it costs money to bring environmental litigation,

and what really kills you is,

if, when you lose, you have to pay the other side's costs,

as you do in the UK.

We said this was only going to work for the Chinese environmental groups

if, when they won a case,

they had all of their costs paid by the polluters,

오염물 배출 기업이 소송 비용을 부담해야 하지만,

but when they lost, they would not have to pay any of the polluters’ costs.

환경단체가 패소하면 기업의 비용을 부담하지 않도록 말이죠.

Because, win or lose,

they were asserting the interests of the public at large.

대중의 관심을 끌게 될 테니까요.

Three months after that, I found myself back in a meeting in Beijing;

this time, in the Supreme Court building just off Tiananmen Square.

이번엔 천안문 광장 앞에 있는 대법원 건물 회의실이었죠.

I was there with the head of the EU-China Environment Programme.

그때는 유럽-중국 환경 프로그램 담당자와 함께 갔습니다.

We were sitting at a white marble table that seemed to be 40 feet long.

저희는 12m도 넘어 보이는 흰색 대리석 탁자에 앉아 있었고,

Across from us were three Supreme Court judges.

그 너머에는 세 명의 대법원 판사들이 있었습니다.

A senior judge began the meeting

부장판사는 회의를 시작하며

by saying that they had accepted almost all of our recommendations,

저희 제안을 거의 대부분 받아들이기로 했다고 말했습니다.

including the key recommendation on costs.

소송 비용에 대한 제안도 포함되어 있다고 하면서요.

So at one stroke,

the Chinese system became friendlier to citizen environmental groups

trying to enforce the law

than many countries.

The senior judge then said, "What do you want to do next for China?"

그리고 부장판사가 말했습니다. “다음으로 중국이 할 일은 뭔가요?”

Now on my prior trip,

저의 이러한 경험에서 새로 알게 된 사실은,

I had learned that the Chinese had just appointed

중국은 환경 재판 판사들을 1000명 넘게 임명했다는 것입니다.

1,000 environment court judges.

Now environment judges, specialists, are rare around the world.

현재 환경전문 판사, 전문가들은 세계적으로도 드뭅니다.

In Europe, for example, there's just a handful in Scandinavia.

유럽 스칸디나비아의 경우에는 손에 꼽을 정도로 적죠.

Their idea was that, by appointing all of these specialist judges,

이 많은 전문적 지식을 갖춘 판사를 임명하는 그들의 생각은,

방대한 양의 환경 문제 사안을 듣고

they would hear a vast volume of cases

and raise the quality of the rule of law for the environment in China quickly.

"So," I said, "you might want to train those judges."

They then asked us to train the judges.

But I had never trained a judge in my life.

So I said, “Where shall we start?”

"With us," he said.

"With the Supreme Court?"

"But what do you want to learn?"

"Well," he said, "we want you to come back

and give us a seminar on climate litigation,

because you're an expert in that."

I said, "Gladly, but what's the thought behind your request?"

And he said,

“We want to know the best climate change cases in the world,

because we want to decide some of the best climate change cases

here in China."

Now I can assure you that I had never had such a conversation

with the Supreme Court in Washington --

(Laughter)

or even London or Paris.

런던이나 파리에서도요.

Certainly nowhere other than Beijing.

베이징 말고는 아무 곳도 없었죠.

So we teamed up with the head of the EU-China Environment Programme

그래서 저희는 EU-중국 환경계획 책임자와 한 팀이 되었습니다.

to create a ClientEarth office in Beijing.

베이징에 클라이언트 어스 사무실을 개설하려고요.

He then organized this training seminar for the Supreme Court,

그리고 최고인민법원을 위해서 세미나를 열 준비를 했고,

where we discussed trends in climate litigation around the world.

저희는 환경문제 고발 건과 관련한 세계 동향에 대해 의논했습니다.

He then organized training sessions

그리고는 전문 판사들을 위한 교육 훈련 계획을 준비했습니다.

for all of those specialist environment court judges.

Now more such judges have been appointed in the meantime,

그동안 양성된 판사들이 정식 임용되었고,

and as of today,

지금까지 1,500명이 넘는 판사들을 양성시켰습니다.

we've trained more than 1,500 of these judges.

About a year after we started training the judges,

저희가 판사 양성을 시작하고 1년쯤 지났을 무렵,

a prosecutor came to our office and said,

검사 한 명이 사무실로 찾아와 이렇게 말하더군요.

"In that law that you helped write,

“여러분이 법안 작성을 도와주신 덕분에

we, the prosecutors, got the right to sue the Chinese government

저희 검사들이 국민들을 대신해

중국 정부를 환경적 문제로 고소할 수 있게 되었습니다.

on behalf of the people, for environmental matters,

and we've never had the right to sue the government before."

예전에는 정부를 고소하는 일은 절대 할 수 없었습니다.”

ClientEarth, on the other hand, sues governments all the time.

우리 클라이언트 어스는 늘 정부를 상대로 소송을 제기합니다.

(Laughter)

So they were asking us to share with them

그러면서 그들이 저희에게 요구한 것은

our experience of suing governments.

정부 소송에 대한 우리의 경험을 공유해 달라는 것이었습니다.

This was the Chinese federal prosecutors asking us to train them

to sue the Chinese government.

(Laughter)

It is the most amazing request I've ever had.

지금껏 이렇게 놀라운 요청은 처음이었습니다.

So, of course, we started working with them.

We've now trained over 1,200 prosecutors in how to bring environmental cases.

A few months ago, (Laughs)

we got a letter hand-delivered

from the prosecutors to our Beijing office.

Now what I'm told by my friends in Beijing,

ordinarily, the last thing in life you want to get

is a letter from the prosecutors.

검사들로부터 온 편지라고 해요.

This, however, was a thank-you note,

and what it said was "Thank you for your cooperation with us.

이렇게 쓰여 있었죠.

“저희와 협력해 주셔서 감사드립니다.

As a result of cooperating with you,

여러분과 협력한 덕분에

we have brought, in 2020 alone,

2020년에만 무려

over 80,000 environmental cases."

8만 건의 환경 문제들을 처리했어요.”

Audience: Whoa.

청중: 와!

80,000 cases, and the majority of those cases

80,000 건의 사건 중 대부분은

were brought against government departments.

정부 부처에 대한 소송 건이었습니다.

Now, the prosecutors have set up bureaus all over the country

현재, 검사들은 전국적으로 지부를 설립했으며,

to keep pushing out this level of cases

그 이유는 이 정도의 사건 양을 지속시키고,

to raise compliance standards throughout the country.

전국적 준수 기준을 높이기 위함입니다.

Now if this isn't a revolution, it's certainly a sea change.

만일 이게 혁명까지는 아니더라도 확실히 큰 변화라고 할 수 있죠.

Now, whenever I talk about China, I'm always asked about coal.

제가 중국에 대해 이야기할 때, 늘 석탄에 관한 질문을 받습니다.

China burns more coal than any other country.

중국은 다른 국가들보다 더 많은 석탄을 채굴하죠.

We're working on that.

저희는 지금 그 문제를 다루고 있습니다.

Following the money, we've been working, for some years,

저희는 몇 년 간 자금을 추적해 왔습니다.

with the largest banks and financial institutions in China.

중국 최대 은행과 금융 기관들의 자금 흐름을 추적했죠.

The argument we've been making

저희가 주장하고 있는 것은

is that coal is simply a bad investment for them to make.

석탄 산업은 투자하기에 좋은 자원이 아니라는 것입니다.

Recently, we had a two-day seminar in Beijing

최근에 저희는 그들 기관을 상대로 베이징에서 이틀 간 세미나를 가졌습니다.

for these institutions,

and it was very heartening to see

그때 무척 감명 깊었던 것은

that that argument that coal is a bad investment

석탄에 투자하는 것은 좋지 않은 방법이라는 논제가

has now been internalized by these institutions

이러한 기관들에서 정식 논제로 인정되고

and taken into their own thinking.

그 문제를 재검토하게 되었다는 것입니다.

When it comes to enforcement,

이 법제가 시행되면,

the prosecutors have a new, fantastic opportunity.

검사들은 새롭고 기상천외한 기회 또한 얻을 수 있을 것입니다.

Recently, a government audit

최근 국정감사로 밝혀진 바에 따르면,

found that many of the new coal-fired power stations

중국에서 최근 새로 만들어진 석탄 화력 발전소들은

authorized in recent times in China

were authorized illegally by provincial officials

지자체가 대차대조표 확대를 위해 불법 승인한 것들이었습니다.

who wanted to boost their balance sheet.

Because these were illegally authorized,

불법적인 방법으로 승인되었기 때문에

they are a perfect enforcement target.

완벽한 법 집행 대상이었죠.

Now, another major problem is all of the coal-fired power stations

또 석탄 화력발전소에 관한 또 다른 큰 문제는,

that Chinese companies have been planning to build

중국 기업들이 다른 나라의 기반시설에 투자하면서

outside China, in Belt and Road development countries.

또 다른 석탄 발전소를 건설할 계획이라는 것입니다.

So we've been working, alongside many others,

그래서 저희는 많은 사람들과 대화를 나누었죠.

with the Ministry of Environment,

특히 중국 환경부와는

to try and figure out how you stop all of those coal-fired power stations

석탄 발전소와 파이프라인 가동을 멈출 방법을 끊임없이 논의했습니다.

in the pipeline.

And what is wonderful news is that, in September 2021,

그리고 2021년 9월에 전해진 한 가지 놀라운 소식이 있다면,

President Xi Jinping, at the UN General Assembly,

중국의 시진핑 주석이 UN 총회 연설에서

announced that China would not fund or build

중국은 더 이상 이러한 석탄 공장을

any more coal-fired power stations outside China.

국외에 짓지 않겠다고 선언했습니다.

We also have reason to believe -- and good reason, I think --

제가 생각하기에는, 그것을 좋은 의미로 보자면

that China’s own emissions will hit their peaking plateau soon

and then will seriously decline before 2030.

Now, does more need to be done in China?

Certainly -- a lot more, and faster,

just like in every other country.

But what I've found heartening

are all of these changes to the system that they've been making in recent years.

All of these environment court judges,

the tens of thousands of cases,

정부 부처를 상대로 한 수만 건의 재판들,

many of them against government departments;

the Ministry of Environment getting enhanced powers;

the largest banks and financial institutions

대형 은행과 금융기관들의

realizing that coal is a bad investment;

석탄 산업은 나쁜 투자 대상이라는 인식,

the president promising no more coal outside China.

중국 국가 주석은 해외 석탄 투자는 더는 없을 거라고 약속했습니다.

We work in many countries around the world,

우리는 전 세계의 많은 국가에서 일합니다.

but I have never seen the intense focus on systemic change

moving a country towards environmental improvements

as I've seen in China.

I'd like to think that I have given you reasons for hope.

China has certainly given me hope.
