I'm going to tell you a true story,

Now think about your favorite musician getting sued, and that lawyer saying,

I think you heard their song and then you wrote yours.

You violated their copyright."

And imagine your musician saying, "No, it's not true.

Think about whether that's fair or just.

This actually happened to George Harrison, the lead guitarist of The Beatles,

Maybe there are only so many melodies in this world.

And The Chiffons, when they picked their melody,

This is a different way of thinking about music

in a way that judges and lawyers nor musicians have thought about.

Because when those groups have thought about musicians,

they think about them drawing from their own creative wellspring,

That's actually not true.

you have to avoid every song that's ever been written,

because if you don't, you get sued.

If you're lucky, you pluck one of those already existing melodies

that hasn't been taken.

Whether you've heard that song or not, maybe you've never heard it before.

If that happens, if you're lucky,

And you change it before it goes out the door.

Now, if you're unlucky, you don't have somebody telling you that,

you release it out in the world,

the group hears your song and they sue you

for a song maybe that you've never heard before in your life.

You've just stepped on a melodic landmine.

The thing is, this is the world before my colleague, Noah Rubin, and I

저와 제 동료인 노아 루빈이 저희 프로젝트를 시작하기 전까지는

have started our project.

그랬습니다.

The world now looks like this.

이제 세상은 바뀌었습니다.

We filled in every melody that's ever existed and ever can exist.

Every step is going to be a melodic landmine.

And ironically, this is actually trying to help songwriters.

Let me tell you how.

I'm a lawyer.

I've been a lawyer since 2002.

we came to a realization that you may have had saying,

And there's a reason for that.

We've discovered that there is only so many melodies,

한정된 수의 음이 한정된 방법으로 나열되는 것이죠.

there are only so many notes that can be arranged in so many ways.

그것이 시각 예술과 다른 점은,

And that's different than visual art,

시각 예술에는 무한한 수의 붓질, 색상, 주제가 있어서

where they're an infinite number of brushstrokes, colors and subjects

that to accidentally do them is very difficult.

Similarly with language,

the English language has 117,000 words in it,

so the odds of accidentally writing the same paragraph are next to zero.

Now, it's remarkably small.

I worked in cybersecurity,

and I know if I wanted to attack your password and hack your password,

So I thought, what if you could brute force melodies?

What if you could say, Do-Do-Do-Do, Do-Do-Do-Re,

도-도-도-도, 도-도-도-레, 도-도-도-미, 도-도-도-파,

Do-Do-Do-Mi.

And then exhaust every melody that's ever been.

And the way the computers read music is called MIDI.

컴퓨터가 멜로디를 읽는 방식을 ‘미디(MIDI)’라고 하는데요.

And in MIDI it looks like this Do-Do-Do-Do, Do-Do-Do-Re.

미디로는 이렇게 됩니다.

So I approached my colleague Noah,

I said, Noah, can you write an algorithm

And the thing is, to be copyrighted,

you don't have to do anything formal.

As soon as it's written to a fixed, tangible medium, this hard drive,

it's copyrighted automatically.

Now, this leaves copyright law with a very interesting question,

because you think about the world before

Noah and I have exhausted the entire melodic copyright.

So if you superimpose the songs that have been written, in red,

Now, you might think at this point,

And I would say, no, absolutely not.

Noah and I are songwriters ourselves.

We want to make the world better for songwriters.

So what we've done is we're taking everything

Some of the insights that we've received as part of our work

is that melodies to a computer are just numbers

because those melodies have existed since the beginning of time,

and we're only just discovering them.

So the melody Do-Re-Mi-Re-Do to a computer is literally 1-2-3-2-1.

도-레-미-레-도라는 멜로디가

So really the number 1-2-3-2-1 is just a number.

말 그대로 1-2-3-2-1은 그저 숫자입니다.

It's just math that's been existing since the beginning of time.

And under the copyright laws, numbers are facts.

And under copyright law, facts either have thin copyright,

So maybe if these numbers have existed since the beginning of time

maybe melodies are just math,

which is just facts, which maybe are not copyrightable.

Maybe if somebody's suing over a melody alone,

not lyrics, not recordings,

but just the melody alone,

maybe those cases go away.

Maybe they get dismissed.

Now you might say, well, what constitutes a melody?

And we were initially going to take the entire piano keyboard

because it turns out that that's even easier.

we're focused on melodies.

And the thing is, we're running out

because the song isn't just a single melody,

but there are many parts to a song,

and each part of that song can have many motifs and melodies within it.

So each song can have up to ten melodies and motifs.

So SoundCloud, which is a way that musicians can upload to this website

음악가들이 곡을 올리거나 판매하는 사운드 클라우드라는 사이트가 있는데요.

and distribute their work,

SoundCloud currently has 200 million songs,

and the number of open spaces is shrinking exponentially.

Because every basement musician is recording, and they’re recording

We're trying to be able to take those green spots,

And if you get sued, you're going want to think about

Second question is: Did you infringe their copyright?

So to the first question, maybe the answer to that is no,

because if they're suing just over the melody,

멜로디를 가지고 소송을 한다면,

그 멜로디는 아마도 태초부터 이미 존재했을 테니까요.

maybe that melody's existed since the beginning of time.

수학적으로 한정된 음정이기에 저작권에 해당될 수도 없을 것입니다.

Maybe there are only so many notes that are math, that are not copyrightable.

To the second question did you infringe, there are two sub questions.

두 번째 질문인 침해 여부에는 두 개의 추가 질문이 뒤따릅니다.

첫 번째는 기존 노래를 접하고, 그 노래를 들었냐는 겁니다.

The first question is: Did you access, did you hear that previous song?

And if so, are those two songs substantially similar?

만약 그렇다면, 두 노래가 상당히 비슷하냐는 것이죠.

Now the first question: Did you access or hear that previous song?

먼저 첫 번째 질문인 기존 노래를 접했거나 들었는가?

That's got a lot of problems, it's really problematic.

그 점은 아주 문제가 많습니다. 진짜 문제입니다.

And the reason for that is there are only a few cases

접한 적이 있는지가 분명한 경우는 거의 없기 때문입니다.

where access is crystal clear.

존 포거티의 경우를 예를 들면,

For example, John Fogerty was alleged to have infringed John Fogerty

크리덴스 멤버일 때의 만든 곡을 자기 표절했다는 의심을 받았습니다.

when he was part of Creedence.

So clearly John Fogerty had access to John Fogerty songs.

On the opposite end of the spectrum, on no access,

what if a baby were to sing into their toy?

And again, as soon as the toy recorder happens,

it's copyrighted automatically, it's a fixed, tangible medium.

So if a baby starts singing

And a year later, Taylor Swift sings, "I stay up too late.

“I stay up too late. Got nothing in my brain.”

Got nothing in my brain."

Clearly, Taylor Swift has not infringed that baby

테일러 스위프트는 분명히 그 아이의 저작권을 침해하지 않았죠.

because Taylor Swift has not heard that baby's recording, OK?

테일러 스위프트가 그 아이의 녹음을 안 들었을 테니까요.

Clear case of no access.

접근성이 없는 경우입니다.

But the thing is, almost none of the cases are that clear.

문제는, 그렇게 분명한 경우는 거의 없다는 겁니다.

What if there's a question mark

두 번째 사람이 음악을 들었냐는 게 질문의 핵심이라면

as to whether the second person heard it or not?

들었을 수도 있고, 아닐 수도 있습니다. 들었지만 잊었을지도 모르죠.

Maybe they heard it, maybe they didn't.

Maybe they heard it and forgot it.

어쩌면 무의식적 침해일 수도 있습니다.

Maybe they subconsciously infringed.

이들 모두가 법에서 말하는 사실 관계입니다.

These are all what the law calls fact questions.

And the thing is, almost every copyright case that comes out is a fact question.

지금까지 거의 모든 저작권 소송은 사실 관계가 관건입니다.

Almost never is it as clear as John Fogerty

존 포거티나 테일러 스위프트처럼 분명한 경우는 거의 없죠.

or as clear as Taylor Swift.

거의 모든 사건의 중심에는 사실 관계가 있습니다.

Almost every case is that middle section,

that fact question.

사실 관계의 어려운 점은

And the hard part about fact questions is they're notoriously hard to resolve

소송 시작 단계에서 해결하기가 징그럽게 어렵다는 것입니다.

at an early stage in the case,

because when you think about a life span of a lawsuit,

법률 소송의 절차를 보면, 그 시작은 사용정지 명령입니다.

it starts out as a cease and desist letter.

보상하지 않으면 고소하겠다는 것이죠.

You need to pay me or I'll sue you.

소송이 진행되면 수 년이 소요됩니다.

It goes forward and it's going to take years.

사실 관계 확인은 소송 막바지에 가서야 해결되죠.

And the thing about fact questions,

they don't get resolved until the end of that process.

조지 해리슨에게 일어난 일입니다.

That's what happened to George Harrison.

배심원 재판 후 판사가 말했죠. “나는 무의식적 침해라고 생각합니다.”

After trial, the judge said, "I think you subconsciously infringed."

만약 여러분이 작곡가라면 전혀 들은 적이 없는 멜로디인데도

So if you're a songwriter who's never heard a melody before,

누군가가 찾아와서 자기 노래를 훔쳤다고 한다면

but you are approached by somebody saying you stole their song,

어떻게 하시겠어요?

what are you going to do?

Sam Smith was approached by Tom Petty.

샘 스미스에게 톰 페티가 찾아와서 이렇게 말했습니다.

Tom Petty said, “My song ‘Won’t Back Down’ sounds like your ‘Stay with Me.’”

“내 노래 ‘Won’t Back Down‘하고 당신의 ‘Stay with Me’가 비슷합니다.”

Sam Smith reportedly responded,

"Hey, man, I've never heard your song before.

I would look at this long road ahead of me and the prospect at the end

So what are you going to do?

It's not surprising that Sam Smith made Tom Petty a co-songwriter,

giving Tom Petty a lot of his songwriting royalties.

Radiohead had a song, "And I'm a creep. I'm a weirdo."

The Hollies said, "Hey, that sounds like our song."

They made them co-songwriters

Katy Perry had a song that she testified

and the other side didn't dispute it.

They say, "We have no evidence that they actually heard the song,

하지만 유튜브 조회수가 300만이 넘고 그들도 분명 들었을 거예요.”

but we did have three-point-some million YouTube views,

so they must have heard it."

A jury agreed with them and Katy Perry was on the hook for 2.8 million dollars.

Now, if you are an accused songwriter who's never heard the song before,

that is an untenable position.

How are you going to avoid getting shaken down

전혀 들어보지도 않은 것 때문에 시달리지 않으려면 어떻게 해야 할까요?

for something that you may have never heard?

Shouldn't there be an easier way?

더 쉬운 방법은 없을까요?

소송 과정 초기의 증거 심문에서 판사나 변호사에게 주장할 순 없을까요?

Shouldn't there be a way that early on in that process

for a judge or a lawyer to be able to have an early evidentiary hearing to say

멜로디가 사실은 단지 숫자이고, 저작권에 해당되지 않는다고 말이죠.

maybe melodies are math, which are facts which are not copyrightable.

아니면 피소인이 그 음악을 들었다는 증거가 없을지도 모릅니다.

Or maybe there's no evidence showing that this later person

has heard the earlier person's song.

Maybe the idea of subconscious infringement goes by.

그러면 무의식적 침해라는 생각이 바뀌게 될지도 모르죠.

Now if you are a songwriter, you should really care about this

여러분이 작곡가라면 이것을 아주 심각하게 생각하셔야 합니다.

because each day you are walking in a minefield

매일 매일 지뢰가 어디에 있는지도 모르는 채

that you didn't even know was there.

지뢰밭을 걷는 것과 같으니까요.

You’re trying to avoid every song, whether you’ve heard that song or not.

여러분은 전에 들었건 말건 모든 노래를 피하려고 합니다.

And Noah and I, we're trying to preserve those open spaces

so that you can be able to make the music in the public domain

공개된 자유 저작물로 음악을 만들 수 있게 하려고 합니다.

in a way that you've always thought it.

새로운 곡을 만드느냐 마느냐의 문제가 아니에요.

The question is not: “Have I made this new song or not?”

Because no song is new.

새로운 노래는 없기 때문입니다.

Noah and I have exhausted the data set.

The real question:

in the first place?

If you're a judge or a lawyer,

만약 여러분이 판사나 변호사라면,

think about having an early evidentiary hearing

초기 증거 심문을 열것을 고려하시기 바랍니다.

피소인이 증거 입증의 책임을 지고

to be able to take the evidenciary burden from the defendant

to prove negative that they've never heard that song

그 곡을 전에 들어본 적 없음을 밝히도록 할 것이 아니라

and bring it back to the plaintiff where it belongs,

저작권을 주장하는 고소인이

that they have to prove that the other side heard the song.

상대가 자신의 노래를 들었음을 입증하게 하십시요.

고소인들은 멜로디에 관한 사실 관계 이상을 증명해야 할 겁니다.

And they have to prove that that melody is more than just a fact.

And if you are a song lover, you should really care about this

여러분이 음악을 사랑하신다면 이 점을 심각하게 고려하셔야 합니다.

왜냐하면 현재 상황이 작곡가들을 소름 돋게 하기 때문입니다.

because the current state has a chilling effect on songwriters.

Something that I haven't told you is that George Harrison, after the trial,

he stopped writing music for a while.

그는 롤링스톤지와의 인터뷰에서

He told "Rolling Stone" that, after the trial,
